The Legal Forum to Netanyahu: There is no Legal Obstacle Preventing Israel from Providing Care Package to Terror Struck Communities 


 On July 18, the Legal Forum for Israel drafted an urgent letter to Prime Minister Binyamin Netanyahu regarding his objection to the transfer of funds for the purpose of providing assistance to the residents of Kiryat Arba and Har Hevron. The 50 million NIS support package was initiated by Agricultural Minister Uri Ariel, formulated by various government offices, and approved by the Cabinet.

The recent wave of terrorist attacks hit the areas of Kiryat Arba and Har Hevron particularly hard. This much needed assistance is especially crucial at a time when the residents of these areas are under daily attack and have endured devastating numerous tragedies including the murders of Miki Mark and 13 year old girl Hallel Ariel.  

On Sunday, July 17, Prime Minister Netanyahu withdrew the proposal for funding on the grounds that this program raises concerns with regard to international law limitations; consequently, the Ministers could not vote on the matter.

The Legal Forum for Israel immediately drafted a letter to Prime Minister Netanyahu demanding clarifications regarding this statement. The Legal Forum cited some of the conclusions of the Levy Commission Report which states, "We have no doubt that from the perspective of international law, the establishment of Jewish settlements in Judea and Samaria is legal." It states further that "having considered the approaches presented before us..... the State of Israel has a claim of sovereignty in the area.... In light of the above, we have no doubt that from an international legal standpoint; the establishment of Jewish settlements does not lack legality, and therefore this issue may be addressed from the perspective of domestic law."

The Levy Commission was established by Netanyahu in January 2012
to investigate the legal status of unauthorized Jewish settlements in Judea and Samaria.  In light of the Report's conclusions, the Legal Forum states unequivocally that providing government support to these areas is not contrary to international law.

The wave of terror is continuing to pummel the residents of Judea and Samaria and East Jerusalem.  The State of Israel has a legal, moral, and ethical obligation to do everything in its power to assist the population at the forefront of this battle.  This obligation is distinct and is separate from the legal issues at hand, and must always be addressed as such. Israel's legal right is separate from political standpoints, desired policy, or any other legal argument. International law determines clear guidelines in cases involving entities which are in control of territory and allows for operations which are necessary in order to ensure security in these areas. 

There is no obstacle preventing the State of Israel from providing funding and assistance to the residents of Judea and Samaria, and furthermore, it is the State of Israel's obligation and responsibility to do so.
