Why is Shabak after these kids? Why do they stop at nothing to prove that these kids are Jewish Terrorists?  

Why is the Government of Israel after these kids?

My conclusion is because these kids have been brought up on simple faith, Emunah Peshuta, belief in Hashem and in the Torah.  They would like the State of Israel to return to days of Old with a government governed by the rules of the Torah.  With the Baal Teshuva movement, and the Demography becoming more Chareidi, and a lower birth rate among the secular Jews, the people of Israel are now much more open to this kind of government than ever before. Torah is flourishing in Israel.  This threatens those who are presently in control.  By cracking down on the hilltop youth and in the process, defaming the religious Settler Movement, they want to stop these dreams of generations from actualizing. However, in the process of their crackdown they have exposed a self appointing corrupt Judicial System who is above the Law.  They have exposed a government who will not stop at anything to destroy these kids. Why? Perhaps to save their own political position. 

Perhaps they are terrified the public might actually be convinced to change the status quo to make this government one that is more consistent with Torah and Jewish Law.  

Torah law was given to the Jewish People at Sinai and they became a Nation. This happened before Israel was established as a Jewish Sovereignty on the Land itself. 

The harder they try to discredit these kids,  the more holes they will have to plug. Eventually, the existing system of the State will self destruct. Because the establishment of the State of Israel of 1948  was born with an inherent flaw. It did not accept Torah as its system of government.  See below Link to Marienbad Resolutions in 1937.

Let us hope and pray that true Justice will prevail.  We learn from this week's Parshath Shoftim how a miscarriage in Justice  leads to many additional serious Biblical transgressions.  

Blood libeling the youth from Judea and Samaria served to delegitimize the Hilltop Youth and entire Settlement Enterprise.  The Shabak with the support of a biased Israel Supreme Court attempted to create false news and a false perception of equivalency between Extreme Youth Arab Terrorists  based on facts and evidence (indisputable evidence of knifings, car rammings stabbings consistent with a culture of hate education vs  "extreme" Jewish hilltop youth terror activity,  based on price tag graffiti which could have been drawn by anybody,  forced confessions and lies and no real facts and evidence, and surely not consistent with these youth's education coming from their homes and their schools and their communities which condemns acts of terror, like arson against innocent people, Jew or non Jew alike.   Logistically it seems totally unrealistic as well that these youth would risk their lives to enter an Arab Village, find a house in the middle of the village and not even on the outskirts, have time to write graffiti and set fire to some random house without getting caught and succeed in escaping unharmed. 

Shabak and the Israel Supreme Court should be subject for investigation for their extreme bias against righteous hilltop youth and the Settlers!

Court to Decide if Confessions Extracted by Torture Admissible in Duma Arson-Murder Case

(JNi.media) The Lod District Court will be deciding in the coming weeks if testimony extracted via torture from a suspect in the Duma arson-murder investigation will be admissible by the court, according to a report by Kan 11.

The defense claims that the confession of Amiran Ben-Uliel, who was charged with the murder of three members of the Dawabshe family, is inadmissible in court as it was attained through force by the Shabak (Israel Security Service).

A smaller trial has been held regarding a second suspect, a minor, who also confessed under Shabak torture to have participated in attack.

The Shabak appears to consider the minor's confession problematic due to incongruities between the extracted confession and the actual events.

The outcome of that minor's court decision, will dramatically affect the Lod court's decision.

The court also decided to extend the arrest of the minor for the tenth time. After the first six months, the court needs to extend the minor's detention every 45 days.

The testimony obtained by the Shabak from Ben-Eliel, who said he acted alone, contradicts that of Arab witnesses from Duma who claim to have seen multiple assailants that night.

There have been at least half a dozen arson attacks in Duma over the past few years, some of which are suspected to have been part of a two-decade long feud between different clans in the town.

The Lod District Court issued an initial order on Thursday to release to house arrest the minor defendant in the Duma alleged Jewish terrorist case.

The actual release of the minor, which included conditions such as an electronic ankle bracelet, court-approved oversight and a prohibition on his communications, was frozen until Sunday in case the prosecution decides to appeal.

The release order comes two and a half years after his arrested and after the Shin Bet (Israel Security Agency) used enhanced interrogation on him, and about a month after the same court declared much of the evidence against him regarding Duma as tainted because of the harshness of the interrogation.

Even if he is released, he will be kept under house arrest as there are other crimes he is still accused of and the prosecution maintains it may still even be able to convict him as a secondary role-player in the July 2015 Duma arson murders of three members of the Dawabshe family.

On Thursday, the prosecution even issued a statement highlighting that the court had not said that the minor defendant was in the clear on the Duma conspiracy to aid in the murder allegations.

In contrast, the minor-defendants lawyers, the Honenu legal aid group and MK Bezalel Smotrich also latched on to the court's order to free the minor from prison as a sign that he had been kept in prison wrongfully.

Prior to the hearing, Justice Minister Ayelet Shaked had issued a statement calling on the court to act on the basis of compassion toward the minor.

In mid-June, the court confirmed the validity of key confessions of the main defendant in the Duma case giving the prosecution a strong chance to convict, while disqualifying key confessions given by the case's minor-defendant.

The mixed blockbuster decision had, and will have, far reaching consequences, did disqualify some confessions of the main defendant during and 36 hours after enhanced interrogation was used on him.

The Justice Ministry and the Shin Bet have a strong lead toward convicting the main defendant, Amiram Ben Uliel.

Regarding the minor-defendant, the decision means that while he will likely face convictions for lesser price tag attacks, he has a strong chance of acquittal from the Duma case.

The July 2015 arson terrorist attack – which killed Palestinians Sa'ad, Riham and Ali Dawabshe in Duma – and the Shin Bet's admitted enhanced interrogations of the two Jewish defendants created convulsions in the region and within the Israeli political establishment.

In January 2016, the prosecution filed an indictment against Amiram Ben-Uliel for murdering the Dawabshe's and against the minor, for conspiracy in planning the murder and other "price tag"-type crimes. Honenu and the defendants implied that the state was using a gag order to conceal that it tortured the defendants to obtain false confessions.

The court's decision dissected different pieces of evidence in the case for both Ben Uliel and the minor with surgical precision.

Regarding Ben-Uliel, the most incriminating evidence he gave, including a reconstruction at the scene of the crime, will be admitted against him in court as it was given more than 36 hours after the Shin Bet used enhanced interrogation on him.

The court commented that it could see from a video of his confessions at this stage that he was calm, volunteering facts which investigators did not know about and freely cooperating.
In contrast, the court disqualified his confessions both during and for 36 hours after the enhanced interrogation saying that it was not convinced that he was cooperating freely at those points.

Judges Ruth Lorech, Zvi Dotan and Devora Atar went out of there way to say that this did not mean that they were characterizing the enhanced interrogation as having crossed a line into torture.

In fact, they said that it appeared that the Shin Bet had not merely used enhanced interrogation to discover if the defendants were involved in the Duma terror attack, but had mainly used it to learn about potential new attacks which it believed defendants' organization was planning.

Rather, on the crossing the line question, the judges said they did not need to decide that issue as they could disqualify confessions at that stage merely as not being given freely even if the enhanced interrogation was legal.

However, those confessions of Ben-Uliel which were disqualified were not the key ones, which is why he is now likely to be convicted.

In contrast, the court in mid-June said it was not provided by the Shin Bet with a video of the minor's confessions.

Because of that, because the minor in real time in earl court proceedings said he was just telling the Shin Bet what they wanted to hear in order to escape more enhanced interrogation – all of the minor's key confessions, during and after enhanced interrogation, were disqualified.

This is why the minor has a strong chance of acquittal in the Duma case, for which he was only ever indicted for conspiracy to commit murder and not murder like Ben-Uliel.

Despite that win, the prosecution told The Jerusalem Post that before the enhanced interrogation, the minor had given a hypothetical statement about his actions which matched up exactly to what he and Ben-Uliel later confessed to.

In addition, the prosecution told the Post that some of Ben-Uliel's statements, which were now accepted in evidence, included his fingering the minor.

Overall, the judges appeared to have far more sympathy for the minor due to his age and fragility and this could help him toward an acquittal, though it is not a guarantee.

Personally I don't trust the Government of Israel will even keep their end of the plea bargain since it seems the system is concerned about protecting themselves and saving face and Elisha's welfare is not their top priority. Too much freedom for Elisha means he might possibly conduct media interviews such as were conducted with Ahed Temimi following her release. Surely the government won't risk the embarrassment of the truth being revealed.

Elisha has been in prison for over 3 years, tortured emotionally and physically for a crime he never committed nor convicted of committing..

No one can blame him or his family for this plea bargain.

No one blames him for confessing to an arson he never committed. It sure beats suicide which he apparently attempted as a kid following torture and interrogation and a judge who fell asleep when Elisha showed him his wrists.

His forced confession of the Duma arson was thrown out for good reason. Under torture, physical or emotional, he is not a credible witness against himself. (Who among us would not confess under the circumstances?)

This is just another forced confession by a fake Judicial process that continues to put Elisha and his family  under tremendous emotional duress and emotional blackmail.

The reality is that there is no lawyer in Israel who will dare represent a kid who can legitimately justify bringing charges  against the Prime Minister of Israel, the President of Israel, the Defense Minister of Israel, the Justice Minister of Israel, the Supreme Court of Israel, the Jewish Division of Shabak, MKs, and the Media and prestigious Rabbanim  complicit for prematurely and falsely  condemning "Jewish Terror" in the Duma case, some within 24 hours of it occurring.  The public condemnation against Jewish Terror in August 2015 soon  went viral, across the globe, even to the New York Times within a week, with no real investigation to speak of. It was based solely on very questionable, nonconvincing Hebrew Graffiti found at the scene of the crime and the "professional expertise and say so" of a biased Jewish Division of Terror of Shabak. 

This Jewish Division within Shabak has a long history and record of looking to manufacture Jewish Terrorists for political motivations.

Based on the given that Hilltop Settler youth are ticking time bombs, tens of innocent, idealistic,  youths who love the Land of ISRAEL, (maybe hundreds), some minors, were denied due process, interrogated, denied counsel and habeas corpus, some tortured emotionally and physically, and worst of all, slandered.  Their good name was publicly smeared by reputable, trusted, powerful and influential leaders of ISRAEL. 

I am not only talking about Elisha and Amiram. Again, tens if not hundreds of Settler Youth were treated as if they were ticking time bombs and this has not ceased till today, as they are at the mercy of Administrative Detention, a politically biased court, biased prosecution, and biased investigation. 

President Trump would accurately call it a "Witch Hunt"!

Hoax crimes like Graffiti has been used way before the Duma arson as a successful tool to incriminate innocent people for political motives.

The Jewish Division of Terror of Shabak has a history of planting agents and moles among Settlers for the purpose of creative a false narrative of Jewish Terror.

If this plea bargain will continue to perpetuate a false narrative, slandering Settlers as "Jewish Terrorists", it serves only to protect all the VIPs who were too quick to condemn the arson on Jews, quick to slander and destroy the lives of beautiful Settler kids and their families for political reasons.

Leadership in the  Settlement Enterprise, so it seems, had no choice but to distance themselves, single out the Hilltop Youth,  or else be slandered along with them. Was it government blackmail? Fear of  losing crucial government stipends, funding for their Yeshivot, and their jobs?  Was there any alternative from their perspective but to join the slander? They too will need to answer to a Higher Authority.

We as a people can choose to persist in this false narrative for the benefit of protecting all those in leadership roles who rushed to falsely condemn Hilltop Settler Youth prematurely for political gain or we as a people can and must insist that there is due process. The courts must free Elisha for lack of evidence and focus on Truth to find the real perpetrators of this Duma arson (who most likely are not Jewish!). 

The very sad reality is that this option was never even explored as opposed to the "Given" which was that the perpetrators were Jewish Youth branded as terrorists.  The  arsonists are still free while Elisha and Amiram are taking the punishment for crimes they never committed.

Am I condemning innocent Arabs for the arson? Chas veShalom! However after 3 years of no credible evidence proving that it was Jews that committed the arson shouldn't we explore the possibility using resources we have, to investigate the Arab clans that perpetuated arson in the past against the Dawebshe family and find the truth and get to the bottom of what happened!

If Nick Sandman's family, the MAGA hat wearing kid, is suing those who slandered his good name for hundreds of millions of dollars, Elisha's family should sue the guilty parties billions of Shekalim and this plea bargain should be rejected in the name of justice! 

Elisha's  3 price tag confessions and confession of conspiracy of arson are simply not credible and in all likelihoid were due to emotional blackmail which is the modus operandi.
