IM TIRTZU AND ISRAEL'S 19TH KNESSET 

SUMMARY

 

Sworn in on 5 February 2013, Israel's 19th Knesset was unusually short-lived.  Even with this limited time frame Im Tirtzu was active among Knesset members and decision-makers.  This report highlights Im Tirtzu's many activities in the 19th Knesset and, for your convenience, it has been arranged by topic rather than as a timeline. 

The first item is the most topical and will lead into the elections of the 20th Knesset, taking place 17 March 2015.

 

Ronen Shoval, founder of Im Tirtzu, is running for the Knesset

Ronen launched his primary campaign for a slot on the Bayit HaYehudi list.  While Im Tirtzu is an extra-parliamentary movement, sending an "ambassador" fulfills its own strategic goals.  Since our mission is to create a Zionist elite, we hope to see many members of Im Tirtzu eventually run for office or take on other leadership roles as a natural progression of our vision.

Many volunteers from the movement are supporting Ronen's campaign and we all wish him great success!

 

 

2nd Annual Zionist Human Rights Conference

Im Tirtzu held the 2nd Annual Human Rights Conference on International Human Rights day, 10 December, at the Diaspora Museum at Tel Aviv University.  The timing of the conference coincides with the start of the election campaign and the integration of human rights and Zionism is vital for the election.

The conference was divided into two parts.  In the first part, Matan Peleg, CEO of Im Tirtzu, presided over a discussion on Israeli civilian issues.  In the second part, led by Dr. Ronen Shoval, a multi-faith discussion was held on religious issues.  Taking part in the conversation were Father Gabriel Nadaf, Rabbi Yuval Sherlo, and Druze cleric Jihad Kablan.

At the end of the conference awards were presented for Zionist activities to Rabbi Yehuda Glick, an activist for Jewish rights on the Temple Mount, and Anett Haskia, a Muslim Zionist.

Im Tirtzu's campaign to stop Israel's High Court from overreaching its authority during elections

On 25 November 2014, Im Tirtzu held a conference called "The Country under the Rule of the High Court."  The conference launched a public campaign aimed at mobilizing the public and raising awareness among decision-makers to block the High Court from overreaching its authority.  Unchecked judicial action, along with a politicization saturated with post-Zionist worldviews, severely endangers the existence of Israel as a Jewish and democratic state.

Position Paper

Checks and balances are a natural component among branches of government in a democracy.  However, in Israel, the High Court is overstepping its bounds and is starting to take on characteristics of a dictatorship.  This will damage Israel in every field and on every level.  This position paper presents the history of the court, its current divergent path, including the role of the Attorney General and his office, and will provide suggestions on how to return the Court to its natural place in the democratic order.

  • Proposed amendment to the defamation law to include defamation of the IDF. (written and prepared by Im Tirtzu and submitted by MK Yoni Chetboun [Beit Yehudi])

The law currently differentiates between verbal defamation of an individual and verbal defamation of a public official.  In the case of defamation of a public person there is no civil or criminal recourse, which opens up the possibility of exploiting the problematic situation. 

In recent years, Israel's detractors and those working to boycott and delegitimize Israel chose soldiers as convenient targets of slander knowing that legal action will not be taken against them.  Over the years soldiers who have been damaged by slanderous and false allegation have been left with no legal recourse.  

The result is that those who were sent to protect Israel's citizens find themselves stigmatized with no defense.

The amendment seeks to recognize the fact that the IDF and its soldiers are unique among groups in Israel due to the IDF's position on the world stage.  Severe harm is caused to Israel because of false accusations made against the army and the harm caused to IDF soldiers individually who have no way to protect their reputations.

The amendment would allow IDF officers to sue on behalf of the military branch in which they served to protect themselves against anti-Israel propaganda.

Im Tirtzu will continue to promote this bill in the next Knesset.

Committee Participation

Im Tirtzu took part in more than thirty different committee discussions during the 19th Knesset.  A few highlights:

  • On 28 July 2014, the Knesset Interior Committee headed by MK Miri Regev dealt with the issue of police action to respond to incitement among civilians and members of Knesset and specifically discussed the problem of incitement against minorities who want to join the army such as Christian Arabs, Druze, and Bedouins.  Alon Schvartzer, Head of Policy for Im Tirtzu, speaks:

It should be noted that the Minister of Education Shai Piron stated that he would set up an international committee on the state of law clinics in Israel, but "not because of Im Tirtzu's report."

 

Knesset Caucuses

Im Tirtzu chairs the steering committee of the Knesset Caucus to Combat De-legitimization of the State of Israel and is in the planning stages of setting up another caucus for the protection of minorities serving in the army and civil service.  The second caucus has been postponed to the next Knesset.

Summary

Im Tirtzu built warm relationships with dozens of Knesset members during the 19th session. Im Tirtzu raised awareness and provided material and information to Knesset members across the political spectrum from left to right to fully combat the delegitimization of Israel.

The Zionist Guards of Democracy were active and will continue to work in the 20th Knesset.

We plan to continue to advance and promote those legislative bills that have not yet moved forward in our capacity as an extra-parliamentary group.

Im Tirtzu participated in dozens of debates, was involved in dozens of legislative proposals, and, more than anything else, protected Zionist values in Israel's Knesset.

And we will continue to do so.

On Monday night there was a four-way meeting in the VIP lounge at Orly Airport, near Paris, between United States Secretary of State John Kerry and the foreign ministers of France, Germany and Britain. Kerry arrived in Paris shortly after meeting with Netanyahu in Rome. He discussed the wording of the proposed French resolution with these foreign ministers, and ways of avoiding a diplomatic confrontation at the UN in the coming weeks.

On Tuesday Kerry also met the head of the Palestinian negotiating team, Saeb Erekat, and Palestinian intelligence chief Majid Faraj. At the meeting, called by Kerry, he tried to explore whether the Palestinians would consider postponing their moves at the UN. Kerry was slated to meet Arab foreign ministers later on Tuesday. They were going to request that the U.S. not veto a resolution on the Palestine issue if it comes to a vote at the Security Council.
 Three leading members of the European Union are reportedly working on a draft resolution to be submitted to the UN Security Council, as a counter to the Palestinian draft expected to be brought to a vote later this month.

The forces in Europe are out there against Israel.

France, Germany and Britain were leading the effort with Paris at the forefront, Haaretz reported Wednesday night. According to the report, the US is aware of the French, German and British initiative.

The resolution is set to outline the principles of a peace deal between Israel and the Palestinians in the time frame of two years. The Palestinian draft also reportedly calls for a two-year deadline, but specifies that this is for a full Israeli withdrawal from occupied territory.

While Germany has refrained from moves that would unilaterally recognize a state of Palestine, both the British and French parliaments have gone that route, albeit symbolically.

On November 17, the European Union harshly condemned Israel for settlement expansion, threatening to "take further action" to respond to Israeli moves deemed harmful to the two-state solution, but refrained from announcing concrete sanctions.

At the same time, an internal EU document was revealed in Haaretz that showed preliminary sanctions the union is considering imposing on Israel, including recalling European ambassadors and cutting ties with Israeli leaders who publicly oppose the two-state solution.


Palestinian envoy to world body says draft demanding Israeli pullout to '67 lines to be presented by mid-month. A draft resolution demanding an Israeli withdrawal to the 1967 lines by 2016, as part of a wider agreement to end the Israeli-Palestinian conflict, will be presented to the UN Security Council by the middle of the month, the Palestinian envoy to the United Nations said Monday.

Here is the Petition to the EU - Mandate for Palestine , explaining that a vote for a third Arab State in Palestine (in addition to Jordan and Gaza) is a violation of international law, since this land from the Jordan River to the Mediterranean Sea was already voted unanimously by Europe and the other League of Nations countries - to be the homeland of its indigenous People, the Jewish People.  The rights of the Mandate for Palestine included the Jewish People's right to settle the land acknowledged to be theirs on the basis of our historical ties which in turn are based on our Biblical inheritance.  THE UN CHARTER - ARTICLE 80 - PROTECTS THE RIGHTS GRANTED UNDER MANDATES - for all the more than 20 countries which were under Mandate - INCLUDING ISRAEL!
 
The EU is needed to deal with the  pitiful state of the surviving Yezidis and others who truly deserve help, to preserve justice for the Jews who have suffered enough, and to not support groups which present annihilationist false claims.

Article 80 and the UN Recognition of a "Palestinian State"

The Signing of the United Nations Charter in 1945.

In the entire debate now taking place on whether the United Nations Security Council or General Assembly has the right to approve the application of the "Palestinian Authority" to be recognized as a new member state of the UN, almost no mention is made of the legal fact that the UN itself is barred by its own Charter from acting upon or approving such an application. The reference here is, of course, to Article 80 of the UN Charter, once known unofficially as the Jewish People's clause, which preserves intact all the rights granted to Jews under the Mandate for Palestine, even after the Mandate's expiry on May 14-15, 1948. Under this provision of international law (the Charter is an international treaty), Jewish rights to Palestine and the Land of Israel were not to be altered in any way unless there had been an intervening trusteeship agreement between the states or parties concerned, which would have converted the Mandate into a trusteeship or trust territory. The only period of time such an agreement could have been concluded under Chapter 12 of the UN Charter was during the three-year period from October 24, 1945, the date the Charter entered into force after appropriate ratifications, until May 14-15, 1948, the date the Mandate expired and the State of Israel was proclaimed. Since no agreement of this type was made during this relevant three-year period, in which Jewish rights to all of Palestine may conceivably have been altered had Palestine been converted into a trust territory, those Jewish rights that had existed under the Mandate remained in full force and effect, to which the UN is still committed by Article 80 to uphold, or is prohibited from altering.
As a direct result of Article 80, the UN cannot transfer these rights over any part of Palestine, vested as they are in the Jewish People, to any non-Jewish entity, such as the "Palestinian Authority." Among the most important of these Jewish rights are those contained in Article 6 of the Mandate which recognized the right of Jews to immigrate freely to the Land of Israel and to establish settlements thereon, rights which are fully protected by Article 80 of the UN Charter.
It should be common knowledge that under the Mandate, all of Palestine was reserved exclusively for the establishment of the Jewish National Home and future independent Jewish State, as was previously decided at the San Remo Peace Conference that took place in April 1920. Or put another way, no part of Palestine was allotted for an Arab National Home or state, since Arab self-determination was being generously granted elsewhere – in Syria, Iraq, Arabia, Egypt and North Africa – which has led to the establishment of the 21 Arab states of today, over a vast land mass from the Persian Gulf to the Atlantic Ocean. There is thus no necessity for a new independent Arab State in the specific area of former Mandated Palestine reserved for Jewish self-determination, most particularly, in Judea, Samaria and Gaza. Creating such a state out of Jewish land would be blatantly illegal under Article 80 of the UN Charter and beyond the legal authority of the UN itself.
In this respect, neither the League of Nations nor its successor, the United Nations, ever had sovereign rights over the land we Jews call Eretz-Israel. As a non-sovereign, the UN has no power whatsoever to allot territory to the "Palestinian Authority" where the allotted territory already belongs to the Jewish People.
Moreover, there is no article in the UN Charter which gives either the Security Council or the General Assembly or even the Trusteeship Council the power to create a new independent state. If the UN had such power, then logically it would also have the inverse power to "de-create" or dismember an existing state, a power it certainly does not enjoy under the UN Charter. If, theoretically speaking, this power did exist, the UN would be in effect a world legislature that could make or unmake states by its own volition, a power that would put in jeopardy the present world order.
For the foregoing reasons, the bill introduced in the US Congress by Ileana Ros-Lehtinen is definitely the proper course of action to follow. UN illegality needs to be roundly condemned and stopped dead in its tracks by an appropriate punitive measure, exactly as Ros-Lehtinen has proposed. Her bill would be even more worthy if it were to include a direct reference to Article 80 and to the fact that the UN has no legal power to create a state or to allot another state's territory for that purpose, accomplished through the devious or underhanded means of accepting the applicant's request for membership in the world body.

A Flaw, an Untruth, in the Proclamation of the State of Israel is Source of Modern Day Crack: This translates into a Curse on the People and the Nation of Israel by Prof. Paul Eidelberg

Brilliant.  Robin  Please read carefully.  The flaw according to Prof. Eidelberg is the denial of the Sinai Covenant in the Proclamation of the State of Israel (read below):

Let me suggest as follows:  

The Secular are in denial of the Sinai Covenant, 

The Ultra Chareidi are in denial of the centrality of the Land of Israel to modern day Judaism and the centrality of the Temple and the Temple Mount to modern day Judaism.  They seem to be of the opinion that modern day Judaism suffices in the prayer  and study halls.  The actual Land  of israel and/or Temple Mount is not relevant especially until the Messiah comes and is revealed.

The Secular focus on being a light unto the Nations taking on a Leadership role as being a Nation and being a Nation with territory while the Ultra Religious focus on being a Holy people. 

We need both perspectives.  When Israel is united we will indeed become a Mamlechet Kohanim VeGoy Kadush. A Kingdom of Priests and a Holy Nation. A Light unto the Nations.

The territory itself, the boundaries of the Land of Israel needs to be in sync with the delineated boundaries specified in the Torah given at Sinai rather than on random boundaries which have changed numerous times in modern history since 1948.  The Law of the Land needs to be governed by Judaic Law which is the union of the Written Law and the Oral Law (Torah Shebichtav and Torah Shebaal Peh) with the High
Court being modeled after the Sanhedrin.

Why does Israel  of today need to be governed by a hodge podge of Turkish and British Law?

Important:  Please note difference between "people" and "nation".  As commentators have noted, whereas an ahm ( (עםsignifies a collectivity united by a religious heritage, goy (גו') signifies a collectivity united only on the basis of a common territory or homeland.

The time has come to correct the flaw with Truth!

According to the first sentence of Israel's May 14, 1948 "Proclamation of the State," the Land of Israel, [Palestine] was the birthplace of the Jewish people [העם היהודי]. Here their spiritual, religious and political identity was shaped. Here they first attained to statehood, created cultural values of national and universal significance and gave to the world the eternal Book of Books."

 

The first sentence of the Proclamation implies that the Jews did not become a people until the conquest of Canaan by Joshua, hence only after the Law-giving at Mount Sinai. The Book of Deuteronomy tells a different story, but some preliminary definitions are necessary. 

 

First, we must define the difference between a "people" and a "nation."  Here I will rely on the fourth-century Aramaic translation of the great Babylonian convert to Judaism, Onkelos (which has been rendered into English and annotated by Israel Drazin and Stanley M. Wagner). However, before consulting Onkelos, let us recall Numbers 23:9 which highlights the unique character of the Jewish people: "Behold a people(עם = ahmthat dwells alone and shall not consider itself [as simply one] among the nations [goyim = plural of גו' ].   

 

As commentators have noted, whereas an ahm ( (עםsignifies a collectivity united by a religious heritage, goy (גו') signifies a collectivity united only on the basis of a common territory or homeland. The Torah designates the Jews aa an ahm as well as a goy kodesh, a Holy Nation (which makes it an ahm). The distinction between an ahm and a goy (עם and a גו') in secular terms corresponds to the difference between a people and a nation

  

people may be monocultural, united not only by language, but also by culture, i.e., endogamous patterns of marriage and by shared religious beliefs and values rooted in a common and immemorial past.  Conversely, a nation can be multicultural as well as monocultural. For example, the Poles and Lithuanians have historically put their ethnicity and national interests ahead of their common religion, Catholic Christianity.  This subordination of religion to nationality (or ethnicity) is to be attributed to the fact that both peoples possessed nationhood  long before they were forced to accept Christianity.  What distinguishes the Jews, however, is religious nationhood.  The "Old Testament," unlike the "New," does not record the source of a religion, but rather the divine founding of a people-cum-nation, and prior to the establishment of its territorial domain.

   

Now let us consult Onkelos with some help from his two translators Drazin and Wagner. Our text is Deuteronomy 26:17-19:

 

You have made the Lord [HaShem] an object of your love this day [the day before the Children of Israel crossed the Jordan River and entered the Promised Land], to be [your God], that you will walk in the ways that are right before Him and keep His laws, His commandments, and his ordinances … The Lord has made you an object of His love this day, to be His beloved people [ahm], as He told you keeping all His commandments. And He will set you high above all the nations [goyim  plural of goy] that he has made, in praise, in renown, and in honor, and so you shall be a holy people [an ahm kodesh] before the Lord your God, as He said [i.e. promised].

 

It should be evident from the preceding that the first sentence of the Proclamation of the State of Israel is misleading, to say the least. By asserting that the Jews became a people in the Land of Israel (Palestine), the secular authors of that document deliberately denied the Covenant that made the Jews a people before they crossed the Jordan River and entered the Land of Israel.  

This explains why the only name that appears in the text of the Proclamation of the State of Israel is that of Theodor Herzl. It also explains why the authors of that document refused to include the name of God, but instead, as a concession to the rabbis that signed that document, substituted the biblical term "Rock of Israel." 

 

But this is not the end of the story. If the opening statement of the Proclamation of the State is deemed misleading if not false vis-à-vis the verses from Deuteronomy cited above, then that statement is a subtle denial of the God as the Law-Giver at Mount Sinai, hardly mitigated by the Proclamation's inclusion of the phrase "Rock of Israel."

 

Now, at risk of being condemned by apologists of the Proclamation of the State, a document cherished by State's ruling class, I dare say that the first sentence of that document is the source of a terrible and self-inflicted curse. 

 

That a curse has descended upon Israel is intimated by the fact that regardless of which party or party leader has been at the helm, it has pursued, year after year, for more than two decades, the same demonstrably futile and existentially fatal policy of "land for peace" – the very land on which the Jews first became a people, and NOT at Sinai.  

The curse has taken or ruined the lives of thousands of Jewish men, women, and children. I repeat: the curse originated in that first sentence of the Proclamation, would have the Jewish People believe that they became a People not by virtue of the Torah to which they gave their solemn word at Mount Sinai, but only by after they entered Eretz Israel.  

What incredible irony! Having denied the Sinai Covenant, the swath of land that supposedly made them a people is now claimed by an "invented" people, the Palestinians, as prophesied in Deuteronomy 32:21: "I will vex them with that which is a non-people ((לא-עם and ano god ((לא-אל.

As serious scholars know, the Palestinians are not a people but an aggregation of terrorist groups hailing from North Africa and the Middle East. As for Allah, let others serious scholars comment on this subject.☼
