Amona is a test case for Israeli democracy  
As a matter of procedure, Israel's High Court of Justice does not examine or evaluate evidence and does not decide issues of land ownership. They rely on what government offices tell them.

Israel's legal and political system is rigged. The fix is in, and Amona is the current victim. There are more communities on the list.  
The pending destruction of Amona led by a handful of unelected, unaccountable, and biased IDF officers and officials of the State compromises Israel's basic principles. Amona, therefore, is a test-case of Israeli democracy.
Amona was built in 1995 on an uninhabited hilltop overlooking Ofra; it was supported by the Ministry of Housing and Construction. But Amona's existence was challenged by Peace Now and Yesh Din who claimed that the land was owned by private Palestinian Arabs -- although they never produced any actual claimants
The Minhal Ezrachi (Civil Administration), the legal authority in Judea and Samaria, and the Prosecutor's Office (Praklitut) – the State -- agreed and asked the High Court of Justice (HCJ) to order the community destroyed
As a matter of procedure, the HCJ does not examine or evaluate evidence and does not decide issues of land ownership. They rely only on what the State (the Minhal and Praklitut) presents. As long as the State affirmed that Jews built illegally on "private Palestinian land," and demanded that the homes in Amona, and elsewhere be destroyed, the HCJ was bound to enforce that decision. Although lacking due process, that is the law in Israel. 
The question of land ownership, however, has not been determined by a court, and Arab claimants have not presented any valid proof which entitles them to the land. Although misrepresented as a judicial decision about the substance of the claim, it is not.
The source of the problem: Jordanian law
The problem originates in the fact that the areas conquered by the IDF in the 1967 Six Day War are under "military occupation," and that the military commander has sole authority. Since eastern Jerusalem was incorporated in 1980 and the Golan Heights in 1981, the Gaza Strip was evacuated in 2005, and Areas A&B given to the PA in the Oslo Agreements in the early 1990's, only Area C of Judea and Samaria remains under military rule; as a branch of the IDF, the IDF Civil Government, Minhal, operates as a separate, unaccountable, and non-transparent quasi- government. This is undemocratic and unjust.
Unilaterally, the Minhal decided to accept Jordanian laws and procedures – although it was under no obligation to do so since Jordan's occupation of the area was illegal and was rejected by the international community.
The proper procedure would have been to follow the Mandate law, since that authority was appointed by the League of Nations, i.e. sanctioned by international law. The Mandate incorporated Ottoman Land Codes and initiated land surveys and land distributions to Arab inhabitants. The Jordanians, following their predecessors, distributed land freely to Arabs and registering land claims -- but they unilaterally changed the law.
Previously, gifted land had restrictions and conditions which had to be fulfilled, such as using the land (usufruct) within a specific time period (3-10 years, depending on the category of land) and paying taxes on it. If the land was not used and taxes were not paid, it reverted to the Sovereign, the State. The right of inheritance was not automatic and could only be approved by the Sovereign/State. 
The Jordanians changed the law by assigning gifted land in perpetuity, as if it was purchased and privately owned, including inheritance rights; they also voided payment of taxes. Moreover, according to Jordanian law, selling land to a Jew is considered a capital offense. Thousands of Arab Palestinian land dealers and agents have been murdered by local gangs, or punished with long prison terms. Under this threat, potential sellers were afraid to deal with Jews. Moreover, it was difficult for Israelis to discover who owned land and what land was available.
According to a military order, land registration records (Tabu) are held by the Minhal and are not open to those who are not included in the Jordanian-era registration process, i.e. Jews.
Politicization, not the rule of law
The struggle to save Amona, like the struggle over the evacuation of Jews from the Gaza Strip and Northern Shomron, "The Disengagement," exposes the politicization of basic institutions of the state – the IDF, Praklitut and the High Court. The "rule of law," has become simply enforcing arbitrary "laws" made by appointed officials, legal advisors and bureaucrats.  
The collusion surrounding "judicial" decisions regarding Amona involves Attorney General Avichai Mandelblit and his opposition to Knesset legislation to save Amona. As Chief Military Advocate General of the IDF between 2004 and 2011, he was responsible for the IDF's vicious attack on Amona in 2005, for the destruction of Migron and Jewish homes in other areas, and he is responsible for declaring that the land on which Amona is built belongs to Arabs. His involvement in this case, therefore, is a clear conflict-of-interest. He should recuse himself.  
Plans to destroy Amona and rebuild it elsewhere are dangerous because they don't deal with the problem. They only reinforce the Minhal's authority and its unfair system of determining land ownership. 
The only fair and just solution is to adopt the Edmund Levy Commission's recommendations, including special courts for determining land ownership. Amona's survival is a test case for the judicial process in Israel and for the rule of law. It is a test case for whether the Government of Israel will act justly and humanely to protect the right of Jews living in Judea and Samaria.
It is a test case for whether elected representatives have any power, and therefore, whether the legislative process is meaningful or meaningless. This is a test case, essentially, of Israeli democracy.

The Trauma That Awaits Amona

If the Regulation Bill continues its way through the Knesset and becomes law, then Amonawill be the "sacrificial lamb", with its structures destroyed and residents expelled. Would the potential benefit be worth the cost?

What would be the benefit? Simply (although there are many details), it is claimed that with passage of the bill, the 400,000 or so Jewish residents living in Judea and Samaria would be safe from any future action like this, since the legality of existing communities would be recognized by the government. Thus, some say, looking at the big, historic picture, evicting 40 families from Amona is an acceptable price to pay.

Is it worth it? If history is a guide, the answer is a clear NO. The gut-wrenching expulsion of nearly 10,000 Jewish residents from Gaza in 2005 is seared in every Israeli's memory, as are the lies Israel's citizenry were told leading up to it. Them there and we here? A recognized border? An end to terror? Did not happen.

Do we know with certainty that passing this bill will once and for all confer legal status to the Jewish communities in Judea and Samaria? Is this a step toward Jewish Sovereignty in Judea and Samaria, or will Amona be destroyed and the bill caught up in the legal system, not implemented, and thus without benefit? And will Israel's government be able to withstand the withering criticism and actions of the international community as a result of the bill's passage?

What we do know at the moment is that detailed plans are in the works for the destruction of Amona and the expulsion of its residents. The following is a reprint of an article in Haaretz, describing those plans. Due to its importance, we reprint it here since the original is behind a subscription firewall.


More than 1,000 Israel Police officers are slated to participate in the anticipated evacuation of Amona in a few weeks, and restraining orders are being issued to 200 far-right activists to keep them from entering the West Bank at that time. The police expect far-right protesters to try to thwart the move at the illegal outpost, but not with the same force used during the evacuation of the site in 2006.
 
Police Commissioner Roni Alsheich has approved the orders for the operation and sat in on the three major training sessions that were held in preparation for it.
 
As the security body with primary responsibility for the area in general, the Israel Defense Forces has been tasked with overall command of the evacuation effort. It will provide auxiliary support for the police, and will handle any incidents involving the Palestinian population during the event, due to occur before Dec. 25.
 
The police will be responsible for dealing with access routes, contact with the civilian population and the actual evacuation of residents.
 
The Shin Bet security service's Jewish department will provide intelligence related to any organized attempts to block the evacuation and to any figures who might disrupt it.
 
There have been several recent security-coordination meetings in advance of the operation, involving the head of the IDF Central Command, the head of the IDF's Judea and Samaria Division, the head of the Shin Bet's Jerusalem and West Bank Division, and the commander of the police's Judea and Samaria District.
 
Moshe Barkat, who heads the latter district's forces, was appointed by police chief Alsheich to command the operation.
 
Ever since the decision was made to remove the residents of Amona from their homes, police intelligence personnel have been trying to gauge the resistance the evacuating forces are liable to encounter, to estimate the number of people who will arrive at the scene from outside the West Bank, and to determine how many families will go willingly and how many will resist. The police's cyber division has also been working to find the far-rightist activists who have been calling for resistance to the evacuation.
 
In the days leading up to the event, with the aid of the Shin Bet, the police will start preventing prominent activists' entry to or removal from the West Bank. There are plans to issue restraining orders to approximately 200 such individuals, which will be in effect until after the evacuation.
 
The police are also considering temporarily detaining a group of approximately 20 prominent right-wing activists, whom they and the Shin Bet have identified as being problematic. Apparently these individuals have declared that they intend to violate orders prohibiting them from entering Judea and Samaria.
 
Several youths who have threatened to use violent measures are believed to have already come to the area and taken up positions on nearby hilltops.
 
The police believe that only a small number of Amona residents are likely to protest their evacuation violently, and that the bulk of the resistance will come from outside. The plan calls for there to be four police officers for every resident who leaves peacefully, but more officers if the person has to be forcefully evacuated.
 
Ahead of the operation the police have established six main units of 100-300 officers each, charged with six different, pre-assigned evacuation tasks. Commanders of the operation are aiming to thwart any private initiatives on the part of policemen that deviate from their assigned mission. This was one of the lessons from the previous Amona evacuation, where the unprofessional actions of some officers only stoked the unrest and made the operation more difficult.
 
The evacuating units will arrive at the outpost unarmed, except for the commander of each force. The troops offering the police cover will be equipped with various crowd-dispersal means. Near the command center that will be set up by the entrance to Amona, additional police officers and mounted police officers equipped with crowd-dispersal equipment will be on standby.
 
IDF and various observation forces will accompany the operation; police helicopters will record events as they unfold to enable the senior officers to assess the situation.
 
Among others posted at the main command center will be fire-fighting forces, Magen David Adom emergency rescue service personnel and vehicles, and other IDF and Shin Bet personnel.
 
Those forces actually entering the outpost will be from the Border Police and the Israel Police's Yasam (special patrol and security) division. Their first destination will be 10 buildings in which protesters may try to barricade themselves.
 
The roads leading to Amona are narrow and the police are also preparing for a situation in which protesters try to block the departure of buses carrying the evacuated residents.

On December 6, Arabs and the leftist group Yesh Din filed a suit against the planned relocation of the town of Amona to another portion of the mountain it is built upon. "The relocation plan was a key part of the compromise reached between Prime Minister Binyamin Netanyahu and Education Minister Nafatli Bennett to pass the Regulation Law without affecting decisions already issued by the Supreme Court." Read Arutz Sheva article here.  
Could it possibly be that the Arabs will "come to the rescue" as they have in the past by rejecting every offer of a "Peace Plan" that's been presented to them? If they force the issue to be reconsidered, who knows...?

Divide and Conquer proposal? Wise up Amona....

Just pick out a few scapegoats and save the rest. Let our enemies still win a victory by allowing them to prove to the world that Israel is occupying Palestinian Land....After all, the GOI, the Gov't of Israel must agree since they are expelling Jews for living on Palestinian Land. 

This is technique they used to isolate a few hilltop youth to portray them as Jewish terrorists. These scapegoats are the Duma suspects whom they have yet to find any credible evidence. These guys were tried and convicted in the secular mdea.  ...The secular media then indulged in spreading the big lie that Jewish settlers are terrorists. They originally put up pictures that made these kids look unkempt. eg Half cut payos of Meir Ettinger which happened when it got caught  somewhere. The subsequent article portrayed them as more typical.  The OPED in the New York Times by Naftali Bennett  easily misled its readers to conclude that all Chareidi Jews and probably all Jews are terrorists.

Minister Uri Ariel (Jewish Home) said on Army Radio that "We are doing everything so that the eviction will be passive, with a clear call not to harm security forces, who are of our flesh and blood," he said. 
My comments.  Nobody wants violence but the Settlers should not be naive by their gracious or shall we say rather stupid declaration of passive eviction.  Remember how their passive unarmed resistance turned them easy targets of riot horses and heavily shielded battalion of soldiers armed with batons.  Let them fight back in the same measure the government chooses to fight them. Them them declare their intention to self defense. 

Rule of Law????? What About Torah Law? Children model their parent behavior. Don't preach rule of law when you are the biggest violator.


Netanyahu Reminds Amona in Letter: Israel is a Nation That Lives by the Rule of Law 
PM Netanyahu urges the residents of Amona and those who stand with them not to turn violent at the evacuation. He urged parents not to involve young children or teens.

THIS VIOLENCE IS NOT BEING INITIATED BY THE SETTLERS BUT BY THE GOI (GOV'T OF iSRAEL).  IN AMERICA THEY CALLED SUCH MEASURES TAKEN AGAINST THEM AS "INTOLERABLE ACTS" AND THEY ORGANIZED MILITIAS TO FIGHT THE BRITISH.

The destruction of Amona and any other settlement that was approved by the Israel Supreme Court till now, will undermine the point of this bill which is the goal of our enemies.  It is not an option and is not on table!

Our enemies has always and will take the opportunity to increase terror whenever homes in Judea and Samaria are demolished in the name of "peace".  It is a tremendous Chillul Hashem!

We can not sit by idly as plans for demolitions in Amona are taking place.  Helen Freedman, the Executive Director of AFSI (Americans for a Safe Israel)  says that Amona is the lynch-pin.   She is in daily contact with the families in Amona, and with Anita Tucker, formerly of Netzer Chazani, expelled from Gush Katif,  who can attest that the situation in Amona is dire and critical.   

David Bedein Director Israel Resource News Agency Center for Near East Policy Research says Amona is the key to Israel and not only Judea and Samaria. He says that a good portion of Jewish communities are built on land claimed by Arab absentee land owners on both sides of the green line. Adalah, Yesh Din, Zochrot and tens of other grantees of the NIF are helping Arab absentee landlord on both sides of the green line.

ג. צא לדרך כרגיל, למשל ניתן להגיע באוטובוס מירושלים (גשר המיתרים) - 
קווים 461, 462, 463, 464, 467,466, 469,
וכמעט כל קו שנוסע לשומרון, לשאול את הנהג.  יורדים בעפרה ומשם טרמפים או רגלית לעמונה.

Temporary arrangement for Amona - in return for trashing the Knesset's Hasdara law (Regulation law under consideration in Knesset which legalizes Jewish communities beyond '67 lines permanently)  
  • Mandelblit does not provide permanent solution for the endangered community of Amona – from which Jerusalem is clearly visible
  •  Even temporary arrangement has price-tag: Vital hasdara bill (which legalizes Jewish communities beyond '67 lines permanently) must be abandoned
  • Amona  community angrily rejects Mandelblit's threat: our kids will not be deported temporarily now -- in order to be deported permanently in 8 months!
  • 2500 homes in danger (scope exceeds disasterous 2005 Gush Katif disengagement)
