Israel's Slippery Slope To Politically Correct Wimpishness

A few weeks ago an IDF soldier shot and killed a neutralized Palestinian terrorist who had just stabbed and wounded an IDF officer in Hebron. The soldier claimed he shot the terrorist due to his fear that the terrorist had an explosives belt hidden under the suspiciously heavy coat he was wearing (it was a mild day).

After a partial video of the event was released by the left-wing NGO B'Tselem, the soldier was promptly pounced upon by Prime Minister Netanyahu, Defense Minister Ya'alon, and just about every leftist in Israel euphoric at the opportunity to nail a soldier with sanction from the higher ups.

Without waiting for an investigation, Netanyahu and Ya'alon figuratively shot one of their own soldiers in a preemptive attempt to placate critics of Israel who look for every excuse to blast Israel for the use of "excessive" force against terrorists.

"Whatever happened in Hebron doesn't represent the values of the IDF," Netanyahu said. "The IDF expects its soldiers to behave level-headedly and in accordance with the rules of engagement." Ya'alon said the soldier's apparent actions were "in utter breach of IDF values and of our code of ethics in combat."

Netanyahu and Ya'alon quickly backtracked after an outpouring of Israeli public sentiment in support of the soldier. But the damage was done. And those on the right side of the political divide were swift to point that out. Education Minister Naftali Bennet accused the two of rushing to "dance to B'Tselem's fiddle." Yisrael Beiteinu chair Avigdor Lieberman demanded the impeachment of Ya'alon and called the prime minister "spineless."

No one disputes the need for cases like this to be tried in a fair and equitable manner. But the prime minister's political calculation, which took the side of a terrorist over a soldier before any of the facts were in, misfired. Not only did it do little to assuage the false claims of anti-Semites against the "oppressive" Israeli army, it further impeded the fight against terror.

Soldiers need to know their backs are covered – or they'll be less inclined to cover the backs of innocent civilians. If they are forced to quash split-second decisions in their favor as they battle an insidious enemy, they end up betraying both themselves and the people they are protecting. A soldier who dies due to an absurd overabundance of caution for terrorists is a tragic loss of life and a symbol of his army's diminished will to fight. A terrorist who dies has simply accomplished his goal.

Terrorists do not abide by rules of engagement. And any fool who tries to accommodate them is not only foolish; he becomes complicit in those acts of terrorism himself.

In an era when every Israeli move is scrutinized and demonized, Israel's leaders need to be especially stalwart defenders of their army. With every knife in the back of a Jew, Israel should defy its critics by doubling efforts to crush the enemy rather than cave to it.

Back in February, Netanyahu slammed Swedish Foreign Minster Margot Wallstrom for accusing Israeli forces of conducting "extrajudicial executions" of Palestinians during the recent wave of violence. Netanyahu would have been wise to maintain a consistent defense a few weeks later in Hebron, because it seems to make no difference to Sweden whether Israeli soldiers are justified or not.

Sweden and other countries hostile to Israel have long pointed fingers at the Jewish state. Whether goaded by outright anti-Semitism or fear of their overwhelming and growing Muslim populations, they seem to believe that every terrorist's life is worth saving and every Jew's life is worth endangering.

Likewise, Netanyahu's protestations against U.S. Senator Patrick Leahy's recent indictment of Israel rings feeble and false when the prime minister maintains an inconsistent front. Leahy, a longtime critic of Israel, and ten House members sent a letter to Secretary of State Kerry asking the State Department to investigate claims of "gross violations of human rights" by both Israel and Egypt. It's a move that could potentially threaten U.S. military assistance to Israel.

Netanyahu responded that the IDF protects civilians from "bloodthirsty terrorists who come to murder them." But those civilians would feel more confident if their leader had demanded investigations into "bloodthirsty terrorists" in Hebron and their accomplices like B'Tselem rather than an Israeli soldier concerned for his safety and the safety of his colleagues.

As a combatant on the front lines of the fight against terrorism, Israel has a moral imperative to powerfully confront the enemy in a battle that goes far beyond its own borders. With Islamist terrorism sweeping the world, Netanyahu's political posturing in a local Hebron skirmish has regional and even global ramifications.

Netanyahu should be exposing rather than obscuring the suicidal realities of leftist policies. American soldiers in Iraq and Afghanistan long complained of having to fight with their hands tied behind their backs. They too were and are simultaneously fighting a real and figurative enemy. And it would be easier for them to take their cue from Israel as a vanquishing fighter rather than a vacillating wimp.

There are real and tragic consequences to America's self-imposed constraints on the battlefield. As Islamist terrorism continues to expand, so will the death toll of American fighters who have to consult lawyers before combating the enemy. It has morphed into a military farce of ask questions first, maybe shoot later.

With pushback from common-sense Israelis and, hopefully, from a new U.S. administration come next January, there may yet be hope for sanity to prevail on the military battlefield. But that sanity has to prevail on the political battlefield first.

Update: Meeting of Moetzet Gedolei Hatorah. Inyanei DeYoma Sheilos

Unfortunately, Rabbi Shmuel Kamenetsky told Shmuel Koenig that Rabbi Feldman did not raise the issue of Meir Ettinger at today's meeting with Moetzet Gedolei Hatorah.  

We understand that Rabbi Aharon Feldman is going to Eretz Yisroel for Pesach.

We are eagerly awaiting opinions, Psak, and/or letters from members of the Moetzet Gedolei Hatorah regarding Inyanei DeYoma.  We would like to hear their positions on:

  • Pidyon Shvuyim: Freeing Meir Ettinger from Adminsitrative Detention.  Freeing Jonathan Pollard from horrible Parole.  Freeing other hilltop youth from Administrative detention and putting a stop once and for all f disabling their ability to incarceration based on Illegal and immoral Orders. .
If they need a precedent, HaRav Moshe Feinstein  sent a Telegram on behalf of Rabbi Meir Kahane in 1980 asking that he be released from Administrative Detention.  Initially, the government of Israel seemed to say that their hands were tied but practically, a month later Rabbi Meir Kahane was released.



Is Administrative Detention according to Halacha allowed in a Jewish Court of Law?  Rabbi Mordechai Tendler says that it is not.

When there is no outpouring of  protest by Hamonei Am, the Government of Israel and the Defense Ministry have the allusion that they can do what they want, and that they can get away with it, and no one will stop them.  Of course all this is false because as believing Jews we know "Yesh Din VeYesh Dayan", we all have to answer to a Higher Authority. 


All of us who are silent as these miscarriages of Justice as they are happening under our eyes,  often not reported in mainstream Jewish Media, will have to answer to a heavenly court as per why we were complicit and didn't even try to stop these illegal orders, miscarriages of Justice from happening.

We are a little over a week away from Passover. However, leading into the Holiday of Freedom, it is just another day and another disturbing article in Arutz Sheva about double standards and discrimination in Israel.

Is there a double standard? Yes!

On Tuesday the city of Jerusalem, supported by the Israeli police, were about to demolish an illegal Arab home built in the middle of a national park, when a call from the office of Prime Minister Binyamin Netanyahu ordered police to stand down.

A government official claimed the decision was necessary to lower tensions.

The Prime Minister's intervention on behalf of the Arab Tutunji family, didn't stop the demolition of a Jewish home, carried out early Wednesday morning - in the Jewish town of Beit El.

At around 3 a.m. Civil Administration enforcement units, supported by Israeli police, arrived at the home of Inbal and Uri Aloni. Within minutes the house was destroyed, leaving the couple - who are expecting their first child - homeless ahead of the Pesach holiday.

Nor did the Prime Minister's Office intervene on behalf of a Carmei Tzur synagogue, dedicated to the memory of the murdered Gilad, Naftali and Eyal, which had been desecrated by Arab arson in February, and destroyed.


How can this be? And why are we seeing this time and again? Why is it if a Jew in Yehuda/Shomron adds an extension to a home or builds a bathroom, orders for their destruction are given and acted on as rapidly as possible. In the meantime, there arethousands of illegal Arab buildings throughout Yehuda, Shomron, Jerusalem, the Negev and the Galil still standing, totally ignored by the Israeli authorities.

Why is lip service being paid to this egregious inequality? When will the Israeli government order and act to tear down the incredible amount of illegal Arab building?

When will justice be enacted equally? 

But the settlers are rebuilding!

A District Court judge rejected a series of appeals on behalf of four Jewish Israelis being detained as part of a Shin Bet investigation Tuesday, despite public protest over the case. 

The judge rejected four appeals against the extension of the suspects' detention, and reject three out of four appeals against the decision to prevent the suspects from meeting with attorneys. 

The cause for the crackdown remains unknown, as circumstances of the case remain under gag order. 

As with the double standard applied to Jewish and Arab building, there is something wrong with this picture - Jewish teens being held in prison without being charged and with no recourse to legal counsel.

WHAT IS THE GOVERNMENT AFRAID OF?

We would like to know.

If the government of Israel is committing evil acts against a segment of the population, and we are complicit, then according to the rules of Grama,  what does it say about ourselves and our accountability in a Heavenly Court? 

If you are in contact with any of the Moetzet Gedolei Hatorah please let them know that you are very concerned about the welfare of these young Jewish kids who have been framed and libeled in the news as "Jewish Terrorists". This then turns into a full grown blood libel on all Jews,  by the likes of the New York Times and International Media, the UN, EU etc.  What started out as graffitti by Jewish Settler kids, in response to provocations of those who destroyed their homes, turns into Arson charges,and charges of murdering a Palestinian baby with his parents in Duma.  How is this different than Blood Libels in the past except that this blood libel  is fueled by unsuspecting Jews who condemn their fellow Jews without evidence or a fair trial other than believing false reports by Shabak?

We hope and pray that HaRav Feldman will bring up the plight of Meir Ettinger in todays meeting with the members of the Moetzet Gedolei Hatorah. We understand that due to our lobbying efforts, Rabbi Aharon Feldman has also written to PM Netanyahu on behalf of the incarcerated Meir Ettinger.

Both Rabbi Mordechai Tendler and Rabbi Feldman chose to follow in the footsteps with Gadol Hador HaRav Moshe Feinstein ZT"L  who in 1980 sent a telegram on behalf of the Late Rabbi Meir Kahane, Meir Ettinger's grandfather ob"m yh"d,  on humanitarian grounds who also was sitting in Administrative detention.  

We hope and pray that HaRav Feldman will be Matzliach in raising the consciousness of the Moetzet Gedolei Hatorah with the goal to make a public appeal from the Prime Minister to release Meir Ettinger,

We believe that an appeal by the MGH on behalf of Meir Ettinger by members of the Moetzet Gedolei Hatorah will bring much needed unity among Am Yisroel especially between Dati Leumi community and Chareidim and this will  have a tremendous rippling effect on the side of Zechus for Am Yisroel!  Shuva Elai VaAshuma Aleichem. Hashem tells us we need to take the first step. (As heard from an amazing Chazaq Torah Lecture by Rabbi Paysach Krohn https://plus.google.com/u/0/+ChazaqOrganizationUSA/posts/UeQREfDnkYc?cfem=1 ).  Such a preemptive action on the part of our Gedoilim BaTorah will surely trigger great upheaval in the heavenly court now in the process of judging Am Yisroel. 

Rabbi Shmuel Kamenetsky expressed his reservations that this proposal would be received with open arms among the members of the Moetzet Gedolei Hatorah.  Shmuel Koenig asked him why not? but did not receive a clear answer.  

We can only guess that there are differences of opinion among the members of the Moetzet Gedolei Hatorah. We have tried to contact each of the Rabbanim individually who seemed amenable to lobby on Meir Ettinger's behalf.  It is our impression that HaRav Perlow tends to lean toward a more Satmer, Neturei Karta like position and we did not approach him but it is entirely possible that our judgement call was not accurate.  Satmer and Neturei Karta holds that the time is not ripe for Israel to have its own independent Sovereign State and we must wait for Moshiach. Neturei Karta has gone so far as to demonstrate with Palestinians chanting "Free Free Palestine" and is considered by many Jews as being traitorous. The Satmer community puts much emphasis on insulation and Kedusha and is at odds for the gov't of Israel for being secular and for not representing a Torah perspective. . In fact, given the way the gov't has been treating the hilltop youth, hilltop youth have good reason to have grievances against the  State of Israel as well.  
However, notwithstanding the position of many members of the MGH like HaRav Sternbuch in EY, regarding their opposition in ascending Har HaBayit bizmaneinu, which differs from Rabbi Moshe Tendler, see below, holding someone in jail without charges or due process such as habeas corpus seems like it is a travesty of justice according to Jewish and secular law.  Rabbi Tendler is of this opinion.

Shmuel Koenig a  dedicated and persistent activist for Eretz Yisroel has been calling the Gedolim on a daily basis.  Shmuel is a very Temimisdic (sincere and idealistic with a touch of innocence and Emunah Peshuta)  person who yearns for the return of the Sanhedrin and for Moshiach to come now in our days. Perhaps it is for this reason, many of the Rabbanim have been amazingly gracious and have been taking his calls in spite of their very hectic schedules.  Shmuel Koenig is persistent in calling upon Members of the Moetzet Gedolei Hatorah to speak up in a forthright manner against a 2 State Solution and for our entitlement of Yehudah and the Shomron based on the Torah and the Covenant Hashem Promised to our Forefathers Avraham Yitzchok and Yaakov.  

His efforts have been reaping positive results.  HaRav Mordechai Tendler and HaRav Feldman agreed to write a letter to PM Netanyahu on Meir Ettinger's behalf.  We of course would love if HaRav Feldman would publicize his letter. 

If any of you receiving this post can lobby these prestigious Rabbanim on Meir Ettinger's behalf it would be greatly appreciated!  

Meir Ettinger and the hilltop youth sincerely yearn for a government in Israel based on Torah.  It seems to me that this yearning is consistent with the Marienbad Resolution of Moetzet Gedolei Hatorah in 1937

Letter being sent to the family of Rav Moshe Feinstein zt"l shortly before Meir Ettinger's wife gave birth.

In 1980, Rabbi Moshe Feinstein zt"l sent a telegram to Menachem Begin requesting that Rabbi Meir Kahane  be freed from Administrative detention based on humanitarian grounds.


Being the Posek Hador one can assume that Rav Moshe understood that this was a Torah matter and not merely a political one.

  

We hope that raising awareness of Rav Moshe's actions on Rabbi Meir Kahane's behalf in 1980 will encourage Rabbanim of our day, with his family members following his lead, to take a public stand regarding the anti Torah practice in Israel known as Administrative Detention. This practice has placed innocent Jewish victims in jail, sometimes placing their lives in danger being placed in security cells adjacent to dangerous Arab criminals, and even torturing them to force a confession for a wrongdoing they did not commit. In addition, many young hilltop youth have been placed under house arrest subject to harassment.


Our goal is to create a public outcry to either bring charges against them for a wrongdoing or release these hilltop youth from immoral administrative detention. If there is evidence of wrongdoing, we ask that the charges be heard in a Jewish court of law rather than secular court.  If there is no evidence and no charges, they should be released.

In 1980 the Posek and Gadol Hador, HaRav Moshe Feinstein, took an active stand to free Rabbi Meir Kahane from Administrative Detention based on humanitarian concerns as well as concerns for his physical danger.  


Apparently according to the Jewish Press, there was great public pressure to release Rabbi Kahane and a telegram from Rabbi Moshe Feinstein, world renowned Torah Authority was hand delivered to Prime Minister Begin at the Jabotinsky Dinner in November 1980. Failing to receive a response, Rabbi Avraham Fisheles, coordinator of the initiative, send another telegram asking why the first telegram remained unanswered.


In response to this second request, Mr. Yechiel Kadishay, the Prime Minister's personal advisor, telephoned the Torah leader and explained that "the matter was not in his hands, and all such requests should be referred to President Yitzchak Navon and Mr. Moshe Nissim Minister of Justice.  When asked how come terrorists have been released as well as others he answered "there are political reasons".  When Rabbi Fisheles asked why it was that Mr. Begin had not personally intervened in the case of Meir Kahane when in fact he did so for Baruch Green, the man arrested with Meir in May, he replied "His hands are tied: has no right to intervene. It's a legal matter."  On the subject of physical danger, Mr. Kadishay explained that here too his hands were tied.  "There are thousands of prisoners in a similar situation and there is nothing more the Prime Minister can do."


Rabbi Meir Kahane was released from prison one month later so perhaps Rav Moshe's efforts on his behalf did have some influence in spite of the response from the Prime Minister's office.


Many parallels exist between the Administrative Detention incarceration of Meir Ettinger of today and of his grandfather the late Rabbi Meir Kahane ob"m hy"d. Meir Ettinger's life is in danger and like his namesake went on a hunger strike. Baruch Hashem he has since ended the hunger strike, listening to the pleas of his family members.  However the factors that led to this hunger strike have not changed.  Meir Ettinger would like to be tried in a Jewish Court of Law rather than a secular court for any charges against him. Rabbi Meir Kahane his grandfather did not respect secular law in Israel. From his writings neither was Rabbi Meir Kahane impressed with right wing politicians like Menachem Begin nor with the election of President Ronald Reagan to change matters. It has to be changed from within.


Meir Ettinger's wife Moriah is now in her 9th month, due to give birth any day.  Rebbetzin Libby Kahane the wife of Rabbi Meir Kahane ob"m, hy"d says that she is praying for a miracle and much Siate Dishmaya that somehow her grandson would be freed from prison for the birth of his child BeShaah Tova Umutzlachat!

Rabbi Kahane believed that Am YIsroel has to stand up for Torah and not expect the Umot HaOlam to do it for us. This is relevant to our day and age as well.  How can we expect any of the Pro Israel Presidential candidates to speak up for our rights to Judea and Samaria if Jews don't speak up?


Many hilltop youth are presently under house arrest have had their human rights violated on a daily basis. Two hilltop youth Elisha Odess and Amiram ben Uliel were tortured until they falsely confessed to the Duma Arson which killed an Arab family. Such self-incriminating forced confessions would never hold up even in a respectable secular Court of Law. Elisha is 17 and tried to take his life according to his family as a result of the torture under Shabak.  These hilltop kids ask is to be tried in a Jewish Court of Law.  From an outsider perspective it seems like they were framed by Shabak.


Arabs were not part of the investigation process of the Duma arson where Jewish suspects were accused simply because Hebrew Graffiti was found near the scene of the crime.  The Jewish suspects reenacted the Duma arson for Shabak and it conflicts with initial reports in the Arab news. Recent reports of another Duma arson of the same Arab clan happened recently apparently not perpetrated by Jews but rather due to family feuds and infighting of Arabs.

THE PARK SLOPE FASCIST COOP

On Sunday, April 10, a hearing was held at the Park Slope Food Coop, and four pro-Israel activists, members of the Coop for over one-hundred years collectively, were suspended from the PSFC for one year. Their terrible crime was trying to prevent the BDS (Boycott, Divest and Sanctions.) from again presenting their hateful, anti-Israel rhetoric from being presented at the monthly General Meeting attended by about four-hundred active members. BDS is an avowed anti-Israel, ant-semitic movement that is fomenting acts against Jews around the world. Several universities have experienced hateful incidents against Jewish students.
The Park Slope Food Coop has been a Park Slope institution for over forty-five years. With a membership of almost 17,000 it is the second biggest coop in the country and a model for other grocery coops.
A small group of BDS members have tried to get the Coop to not carry any Israeli products. Seven years ago, a meeting with over 2,000 members was held at Brooklyn Technical High School, to vote on whether to join a boycott against Israel. The proposal was voted down by an overwhelming majority. The BDS people continue to push their agenda at the Coop. Every time they try to get a proposal to boycott Israel, it is shot down.
A proposal to stop BDS from using the PSFC newsletter, The Gazette, and the General Meeting that is held once a month, has been sent to the Agenda Committee, several times
Over the past several years. The AG committee, which sends the proposals to the General Meeting, has refused to act on the proposal. Obviously, the AG committee and the management of the Coop is sympathetic to the BDS, and abrogates their responsibility to the members at large, by having their own anti-Israel BDS position interfere with the fulfillment of their assigned duties.
The action of the AG, the Disciplinary Committee that brought charges against the four members and the Hearing Officer Committee that handed down this draconian penalty operates with a fascist philosophy.
Shame on the Park Slope Food Coop.
