Letter from AFSI Brooklyn To Prime Minister Netanyahu Protesting Administrative Detention - Jewish Terrorist Law

Dear Honorable Prime Minister of Israel Mr. Netanyahu, mankals@pmo.gov.il

Shalom,

We are writing today to protest a very undemocratic law called: Administrative Detention (also called: the Jewish Terrorist Law) which Israel has as part of its legal system.

This law, as will be described below, removes the word: Democracy from Israel. It is a shameful law that can be used against any Israeli, without evidence, without recourse and for no real positive purpose under the law.

The person accused of a crime using this law is arrested with only suspicion, without evidence, denied a lawyer. Denied due process as every Israeli is entitled to. He or She is then subjected to various forms of torture, until the person, out of their mind with pain confesses to things they never did. This "confession" is then considered legal evidence with which to prosecute the victim (there is really no other word for what he is). The victim of this law then has no recourse, for the process, and method of evidence gathering is completely legal under the law in Israel.

This shameful, anti-democratic law is used against Jews and Arabs alike. It is as if Israel is at a state of war against its own citizenry!

You may be surprised  that we include Arab citizens (or non-citizens or half citizens) in this plea.

However, the black eye this law gives to Israel for lazy police work, and the poor quality of evidence and the flimsy claims of criminal behavior alleged, if producing questionable cases against Jews, must certainly in this form, be producing questionable cases against Arabs as well. In fact one might go as far to say, that its outrageous use against Israeli citizens might well be termed: Political Agenda.

This medieval form of brute punishment without just cause, is disappointing to many of us supporters of Israel who view Israel as the last bastion of democracy in the turbulent Middle East. It's disappointing enough to hear anti-Israel protester's calling Israel a regime. 
Its worse to see aspects are actually truth.

One must ask: If one has evidence, why torture?
If one has no evidence, so let them find it, if any exists.

As for our Arab residents, some may argue: We need it for Arab terror, etc.

So there are two answers for this-

One is that Arab terror is a war crime. This should be dealt with as such, not as a civil crime.

Two is that apparently Israel doesn't seem that concerned with Arab terror.  Israel claims it made peace. If so, it can't be terror that Arabs are blowing themselves up and digging tunnels and firing missiles. Israel seems to often ignore these minor details claiming the perpetrators are enemies of peace. How can we prosecute our peace partners?  So if Israel is truly not concerned, why worry about Arab terror?

And if Israel is truly concerned, so end peace talks which bring more terror, and prosecute Arab terrorists under war-time laws under military law. End Camp David and stop the tunnels. End Oslo and end the land giving which is only used for missile launching against Israelis.

But to needlessly subject Israel's citizens to non-stop military law is unfair and immoral. 

There is not a country in the world that does this, save regimes, and Israel has no need to go that route, for doesn't it claim to be a democracy?

We would like to suggest that you personally support removing this anti-democratic law from Israel's law books.

My last email erred in that it said the Court Hearing was supposed to be on Feb. 21.  Meir Ettinger's wife says it's tomorrow.  Do we want his incarceration on our heads that we stood by and did nothing?  Please davan for Meir Dovid Chai ben Tova. Please fwd this to your Rabbi as well as Letters from Rabbi's and influential people from Chutz LeAretz especially make a difference we are told.

Op-Ed: Trial by the media?

The grandmother of one of the administrative detainees in the Duma story tells her side.

Libby Kahane was married to Rabbi Meir Kahane from 1956 until his murder...

On July 31, 2015 a house in Duma, an Arab village in Samaria, was firebombed by unknown persons and a child was tragically killed. The entire gamut of Israel's "Who's Who" condemned the unknown persons, whom they labeled "Jewish Terrorists" because of questionable graffiti in Hebrew.

The condemnation was not enough to satisfy the New York Times, which quickly published an article titled, "Israeli Justice in West Bank Is Seen as Often Uneven." This was picked up by all the foreign media and our government was pressured into taking hasty, precipitate action.

Among those arrested was my grandson, Meir Ettinger, named for his late grandfather, Rabbi Meir Kahane, who had a reputation for promoting unpopular opinions. He was the perfect scapegoat. He was arrested on August 3 and interrogated using illegal physical force, including punching and shaking him. On Sunday, August 9, he was taken before a judge to extend his arrest, but the court hearing he should have had was cut short by the arrival of an administrative detention order straight from Minister of Defense Moshe Yaalon.

Administrative detention means detention without a trial, meaning it does not allow the accused to challenge the allegations against him.

Leaks to the press by the Shin Bet (the Israel Security Agency), had prepared the ground for Yaalon's order so as to gain public acceptance for this undemocratic act, On August 3, when Meir was first arrested, Israel's Channel 2 television broadcast a lengthy, detailed report that named Meir Ettinger, "the primary target of the Shin Bet." As Meir himself said in a televised report from court, there was no truth in the declaration that the Shin Bet considered him a "primary target." When he was arrested they did not even know that one of his sidelocks, payot, had been torn off while he was working on a construction job. It happened when his right payah was caught up in an electric drill and in all the photos of him in court the length of his payot are uneven, which makes him look unkempt.

There are many inaccuracies in the Channel 2 report, possibly intentional.. For one thing, it claimed that Meir was suspected of writing a document found in his computer titled "The Uprising." In itself, even had this been true, this is a purely ideological statement.

However, as revealed by the weekly magazine Olam Katan (February 12, 2016), there is another document, written by someone else who has no connection with Meir Ettinger. That document, "A Guide to Harming Arabs," calls for violent acts against Arabs. The Shin Bet knows who wrote it. He is currently in prison, being held until his trial ends. But they deliberately leaked parts of that document as if it were part of the document found in Meir Ettinger's computer, creating a negative impression about him in the eyes of the public.

The TV report implied that Meir and a group of young people "invaded" Kusra, an Arab village in the Binyamin area, in order to destroy property there. Actually, they were hiking far from the village, completely unarmed. Police were unable to find any evidence of paint cans, brushes, tools or any weapons that could be attributed to them. The Kusra villagers attacked them and bloodied them and they were photographed by Reform rabbis visiting the village. One photo showed Meir comforting one of his friends who had put a kerchief over his bloody nose. This became a photo of "Meir Ettinger and a masked man."

The report on Channel 2 hinted that the Shin Bet had implicated him the firebombing of a Christian church near the Sea of Galilee and it quoted a "friend of his" saying, his voice disguised, that Meir had charisma and was "cunning and devious."

He has been in jail for six months on an administrative detention order and the Shin Bet has asked the court to approve four more months. The judge said he would issue his decision in 20 days, i.e. February 23. The court proceedings are held behind closed doors; only one judge is shown the "evidence." Neither Ettinger nor his lawyer are told what the charges are and there is no way to argue in his defense.

Instead of being tried in court, where there are rules of evidence and procedure, Meir Ettinger is the victim of a media trial, subjected to a stream of rumors, perhaps even spread by the Shin Bet, creating a false media image of Meir Ettinger and demonizing him. This should sound a red alarm to all honest, decent people.

Anyone can read what he has written openly on his Internet blog. What he has done is not considered a crime in any democratic country. He expressed unpopular views in a blog he wrote on the Hebrew website "Hakol Hayehudi."  When his case came to court for review after his first three months in administrative detention, the judge ordered his imprisonment continued. The reason he gave was that Meir had not changed his views. The Honenu lawyer said, "If the judge wants him to change his opinions, he can send him to Korea, there they know how to make people change their opinions.

One can disagree with the opinions he has expressed but his right to express them is completely legitimate in a state where even the Hezbollah is permitted to freely express its intention to destroy that state, Israel.
