A foundation of American political thought during the Revolutionary period was the well justified concern about political corruption and governmental tyranny. Even the federalists, fending off their opponents who accused them of creating an oppressive regime, were careful to acknowledge the risks of tyranny. Against that backdrop, the framers saw the personal right to bear arms as a potential check against tyranny. Theodore Sedgwick of Massachusetts expressed this sentiment by declaring that it is "a chimerical idea to suppose that a country like this could ever be enslaved . . . Is it possible . . . that an army could be raised for the purpose of enslaving themselves or their brethren? or, if raised whether they could subdue a nation of freemen, who know how to prize liberty and who have arms in their hands?" Noah Webster similarly argued:

Before a standing army can rule the people must be disarmed; as they are in almost every kingdom in Europe. The supreme power in America cannot enforce unjust laws by the sword; because the whole body of the people are armed, and constitute a force superior to any band of regular troops that can be, on any pretence, raised in the United States.

George Mason argued the importance of the militia and right to bear arms by reminding his compatriots of England's efforts "to disarm the people; that it was the best and most effectual way to enslave them . . . by totally disusing and neglecting the militia." He also clarified that under prevailing practice the militia included all people, rich and poor. "Who are the militia? They consist now of the whole people, except a few public officers." Because all were members of the militia, all enjoyed the right to individually bear arms to serve therein.

The framers thought the personal right to bear arms to be a paramount right by which other rights could be protected. Therefore, writing after the ratification of the Constitution, but before the election of the first Congress, James Monroe included "the right to keep and bear arms" in a list of basic "human rights", which he proposed to be added to the Constitution.

Patrick Henry, in the Virginia ratification convention June 5, 1788, argued for the dual rights to arms and resistance to oppression:

Guard with jealous attention the public liberty. Suspect everyone who approaches that jewel. Unfortunately, nothing will preserve it but downright force. Whenever you give up that force, you are inevitably ruined.

While both Monroe and Adams supported ratification of the Constitution, its most influential framer was James Madison. In Federalist No. 46, he confidently contrasted the federal government of the United States to the European kingdoms, which he contemptuously described as "afraid to trust the people with arms." He assured his fellow citizens that they need never fear their government because of "the advantage of being armed...."

By January of 1788, Delaware, Pennsylvania, New Jersey, Georgia and Connecticut ratified the Constitution without insisting upon amendments. Several specific amendments were proposed, but were not adopted at the time the Constitution was ratified. For example, the Pennsylvania convention debated fifteen amendments, one of which concerned the right of the people to be armed, another with the militia. The Massachusetts convention also ratified the Constitution with an attached list of proposed amendments. In the end, the ratification convention was so evenly divided between those for and against the Constitution that the federalists agreed to amendments to assure ratification. Samuel Adams proposed that the Constitution:

Be never construed to authorize Congress to infringe the just liberty of the press, or the rights of conscience; or to prevent the people of the United States, who are peaceable citizens, from keeping their own arms.

Today's Commentary:  Planned Parenthood Funding -- Hillary Reminds Us Why She Lost -- Liberal Militia Forms

Robin,

Federal funding for Planned Parenthood in a "Republican" spending bill? How is this possible? And, more importantly, what can be done about it?

President Trump offered his own explanation for the various inadequacies of this bill in the form of a Tweet: "The reason for the plan negotiated between the Republicans and Democrats is that we need 60 votes in the Senate which are not there! We...either elect more Republican senators in 2018 or change the rules to 51%. Our country needs a good 'shutdown' in September to fix the mess."

The battle lines over abortion have been drawn sharply, with the Democrats digging in to preserve every possible protection for their holy sacrament of even very late-stage terminations (of life), that they make a government "shutdown" virtually inevitable. Of course, they'll actually welcome that "shutdown" because they can then blame Republicans for not compromising, when they themselves are absolutely unbending. "Shutdowns" –- I use the quotation marks because only about one-fifth of the government actually stops working during one –- are treated to such a hysterical reaction in the media that voters lose confidence in their leadership. Trump is right to remind us that we could actually benefit from one, if it comes to that. Voters need to see this as part of the negotiating process.

Just as "appeasement" isn't the basis for a good foreign policy, it's also not the way to deal with Democrats. While they detest the idea of a wall on our border, they put up one of their own to deal with Republicans. Funding for Planned Parenthood is on their side of that wall, receiving protection at all costs. To borrow a phrase from Ronald Reagan, I'd like to say, "Democrats, tear down that wall!" But they never will unless there are severe political consequences to their rigid stance.

The bill is up for a vote this week, and reconciliation is still possible. If that doesn't happen, keep in mind that technically it's a stopgap that was necessary because Democrats never did pass a budget. The crucial battle –- over what is usually the first budget passed by a new administration –- will take place later in the year. In the meantime, moderate Republicans in both House and Senate need to remember that if they don't lay down the law –- literally –- they will likely face severe political consequences of their own. If that happens, the next budget they pass could be their last for a long time.

Hillary Reminds Us Why She Lost

Hillary Clinton reminded us of why she wasn't elected by arguing that the key to bringing jobs back to America is for the government to help bring better cell phone coverage/broadband Internet to rural areas. Also, more tax money "invested" in the solar power industry, or else China will "eat our lunch in the solar market."

The last Administration that she was a part of lost over half a billion dollars of our money co-signing loans for their cronies at the solar panel company Solyndra, which built itself a palatial headquarters, then promptly went out of business because it failed to foresee dropping silicon prices and couldn't compete with Chinese solar panel companies. And that was just one of many "green energy," crony capitalism money sinks that never paid off. Hillary still has yet to learn the lesson of the Obama economy: if you want to create private sector jobs, the government doesn't need to "partner" with the private sector, it needs to get the heck out of the private sector's way. Government is the economy's referee, it's not the quarterback.

Come to think of it, the Obama Administration not only proved that government shouldn't be trying to pick winners and losers in the marketplace with our money, it also proved that it couldn't even make a lunch that anyone would eat.

Liberal Militia Forms (Yes you read that right)

Remember Steve Martin's old bit, where he did a joke that only the plumbers in the audience would understand? Well, here's something just for gun owners (I figure that's a much higher percentage of my audience than Steve Martin had plumbers.)

A handful of liberals suddenly discovered the Second Amendment and ran out to buy guns because their own campaign propaganda scared them into thinking Trump was going to take away their rights. Or else it was a PR stunt to try to intimidate pro-Trump rally attendees. After serious gun owners laughed at them, a "liberal militia" in Arizona made the mistake of trying to prove they actually knew how to use their firearms by releasing a video of them on a firing range. All it proves is that the only kind of shooting they understand is shooting their mouths off. They are very lucky that they at least know which end of the gun the bullets come out of. It's hilarious until you remember that these are the people who think they should be making guns laws for the rest of us.

Say, here's an idea: maybe they should join the NRA and avail themselves of some of their excellent gun safety training materials for children.

Freedom of expression?  ( read about Aryeh Arbus  a righteous soldier that dared to publicly object to expelling Jews from their homes is imprisoned)

Freedom to bear arms and Freedom of Self Defense? (Read what Mordechai Sones and Emmanuel Winston have written about confiscation of weapons in the Shomron )  

Freedom to own property? (Destruction of 22 communities of Gush Katif and Northern Shomron 2005 putting the lives of the residents of Sderot, Ashkelon and Southern Israel in danger, Pending destruction Chas Vechalila of 46 structures in Shavei Shomron and Od Yosef Chai shul in Yitzhar, making way for the establishment of a Palestinian State Chas Veshalom putting the  lives of millions of Israeli's in places like Tel Aviv, Bnei Brak, and Ben Gurion Airport in danger.  What is bad for Israel is certainly terribly bad for America as well!) 

Freedom of Religion? (Biblical References by the Prime Minister of Israel Netanyahu are considered distasteful and an obstacle to "Peace")

Surely these intolerable acts on the part of the Israeli govt as a result of International foreign pressure would justify a militia in Judea and Samaria as defined by the 2nd amendment of our Bill of Rights!  (Thank you Israel Kaplan ob'm for this following reference in response to an antisemitic billboard)
