If you are a Rav raise awareness in your shul and to Rabbinical organizations.  You know better than I how you can help these Settlers who are fighting for Eretz Yisroel.  As Moshe said to Reuvein Gad and Shevet Menasheh will you allow your brothers to fight on their own?

Police Brutally Evict 5 Families from Yissa Beracha Outpost

Police early Thursday morning evicted five families from the new community ("outpost") of Yissa Beracha, a new neighborhood of the town of Mitspe Yericho, located between Jerusalem and the Jordan Valley. Police violently removed the families and beat protesters who had come to demonstrate against the eviction. Nine protesters were injured in the police violence.

The operation, for all practical purposes, constituted a classic "invasion" of the neighborhood, with police sealing off the neighborhood for three hours before the eviction, while others blocked off access roads, preventing protesters from reaching the site, and beating with with clubs and sticks when they tried to reach the site. Police said that three officers were injured, after they fell off a roof they had climbed on in order to remove a resident.

Three of the protesters sustained injuries to the head, and were taken to Hadassah Ein-Kerem Hospital for treatment. Protesters said that one woman was injured when she was run down by a security vehicle; another protester who was hit on the head by police was refused medical treatment, witnesses said, with police preventing doctors from treating him until the evictions and demolition of the structures in the neighborhood were finished. Protesters said that, as has been the case in recent outpost demolitions, police used Arab contractors who gleefully ripped down the structures, cursing and laughing at the Jews while they did their work.

MK Michael Ben-Ari said that "the time has come for the national religious public to understand that the government of Prime Minister Binyamin Netanyahu is bad for the Jews. The obsessive and ongoing demolition of Jewish homes has reached the levels of the eviction of Jews from their homes in Gush Katif and northern Samaria. Netanyahu and Defense Minister Ehud Barak are persecuting residents, evicting children from their homes, and injuring protesters – and afterwards they wonder why there are 'price tag' actions."
Along with the demolition and eviction of five families in the new community of  Yissa Beracha, a new neighborhood of the town of Mitspe Yericho, police and border guards also evicted the Slonim family in the Oz Tzion neighborhood of Givat Assaf. Police tore down the building, with police waving guns and rifles at residents during the eviction. Police deny the report

 Yasher Koach to Knesset Member Rav Yisroel Eichler of Yahadut HaTorah who spoke up in his recent visit to Ulpana in Beit El (h) following the destruction of several homes in Migron. Rav Eichler said:

"Here there is cruelty that I would not expect from a malicious non Jewish government and certainly not of Jews.  Here there are brutal court rulings  against children.  One needs to know that the law of Beit El is the same as Tel Aviv. Attacking Torah and attacking a Jewish community is one and the same.  The destruction of houses is a detachment of Judaism."

In addition, please write to Rav Shlomo Kook (ko@vmail.co.il), a close assistant to Rav Eliashiv, to ask Rav Eliashiv to speak up publicly,  like MK Eichler to denounce the blatant violations of the Written and Oral Torah by the Gov't of Israel  and that it had better stop! It is  clear that initially many Gedoilei Hatorah and Moetzes Gedolei Hatorah were against the "Hitnatkut". (see Hamodia article of 12 Cheshvan 5745 (2005) )

On 24 Teves 5745 (2005)Hamodia reported that 290 million Shekalim was allocated to the Yeshivoth in return for UTJ joining the Coalition thereby leaving the 8,000 Jews of Gush Katif on their own.  (There however was an anguished outcry of Chareidim who attempted to prevent the tragic expulsion from Gush Katif. These can be found in Rabbi Yissocher Dov Rumplers Sefer entitled "Halacha Berura".) 

In 2007 Rav Perlow went especially to Eretz Yisroel asking a Sheila regarding division of Yerushalyim and reported at the Agudah Convention that Rav Eliashiv clearly gave a Psak against dividing Jerusalem and we must proclaim it Bechol Hatokef (Agudah Convention 2007, Motzei Shabbos address by Rav Perlow). Are we abiding with his ruling? At the time activists for Eretz Yisroel Hashleim were disappointed that no message was stated against a Palestinian State.  (However, that would have been politically incorrect and in opposition to American Foreign Policy of the times which promoted a Palestinian Statehood but still supported a United Jerusalem.)    

Odelia Jacobs has documentation that Rabbi Morgenstern in Eretz Yisroel was told the same by Rav Eliashiv regarding our obligation to become activists in this matter.  

In 2008 I wrote in my blog.  I personally spoke to Hadas Rav Eliashiv's secretary and to Rav Efrati.  They both said that if a Mishlachat of Chashuva Rabbanim including Rav Perlow, Rav Kamenetsky, Rav Matisyahoo Solomon, Rav Malkiel Kotler would come to Israel with an entourage of other chashuva Rabbanim to ask Rav Eliashiv to speak out for our entitlement of Eretz Yisroel is would be "mashpia".  My understanding is that Rav Eliashiv who is bli ayin hara around 97 years old needs to know that his people will back him up. There is no question that all the Rabbanim believe of our entitlement especially Rav Eliashiv.  The Novaminsker himself reported that Rav Eliashiv said that giving away Land makes the security situation worse.  The Novaminsker himself acknowledged that Gush Katif was a disaster (at Agudah conventions last year).  Even Satmar can not disagree of our entitlement because this is Torah.  However, all are afraid to state so publicly.  Maybe their concern is what if the Nations of the world express a backlash at the very notion of us insisting on our Land just like Pharoh made it worse for the Jews when Moshe Rabbeinu asked Pharoeh to let the Jews go.  Moshe Rabbeinu asked Hashem "Lama Hareiosa?"  Why did you make it worse after I spoke up.  Rav Eliashiv needs to know that each and every Jew wants Eretz Yisroel very badly and only then will we Am Yisroel have the Zechus of keeping Eretz Yisroel.

This note is a request for your help. Our older daughter, Aviela, is living with her family (husband and 6 children) in the community of Migron. This name may be familiar to you because there have been stories in the media about it within the past few months. Migron is in the Shomron and has been an established community since the 1990's - with the help and support of the Israeli government. From its establishment to the present, there has never been a problem between Migron and its several Arab neighboring communities. Within the past year, however, the group called Peace Now has brought suit, claiming that the land is owned by Palestinians. The Supreme Court gave them a deadline date by which they were to submit documentation to prove this alleged ownership. They were unable to do so. There is, however, the remains of an archaeological excavation from some years ago which proves that the land on which Migron stands was Jewish.

 

Legislation is now being considered in the Knesset which would officially classify Migron as a legal settlement, on similar grounds as others have used to remove their established settlements from the risk of demolition by the government. New Police Tactic: Yitzhar Resident Arrested for Child Neglect by Shalom Pollack Children thrown out in the freezing cold in Mitzpeh Avichai. The Israeli police arrested this morning a Yitzhar resident for investigation on suspicion of child neglect after taking two of his children to visit the Ramat Migronoutpost in Binyamin before the destruction. Three weeks ago, he brought his children there to visit the place and give support to the residents. At six o'clock this morning black-clad Yassam (Special Forces) police banged on the door of the family home and arrested the father of the children, who was taken to the Ariel Police Station for investigation. An attorney fromHonenu, an Israeli legal aid organization, is working to secure the release of the father. The spokesman of Yitzhar, Avraham Binyamin, strongly criticized the conduct of the police and mentioned that only last week Yassam police threw babies and children out of their homes in Mitzpeh Avichai into the freezing cold. See video. "Again the police are conducting themselves like cruel thugs under the pretense of upholding the law", said Binyamin. Last year many Jewish citizens were outraged at the selective enforcement of demolition orders against Jews and Arabs, which was a 2:1 ratio in favor of the  Arabs: Jewish homes were twice as likely to be destroyed as Arab homes. Today one mainly hears about Jewish homes being demolished. Last week, five nationalists, after texting their friends and neighbors to come protest demolitions of Jewish homes, were charged with conspiracy to commit a riot among other charges. These five will be under house arrest with no telephone, internet or communication access until the end of trial which could as much as a year from now. Demonstators injured at Amona Remember Amona Six years ago, one of the most horrendous acts carried out by the Israel Police was the beating of protestors at Amona. Over a thousand Israeli nationalists gathered to demonstrate against the demolition of nine Jewish homes. The police did not arrest, but clubbed the protestors mercilessly. Over 300, mostly youth, male and female, received blows to their heads. Ehud Olmert, Prime Minister at the time, refused to investigate. Even left wing Betzelem had to admit the cruel brutality. Our Just and Moral and Legal Claim is with the Settlers and not with the Government of Israel

When Truth, which is at its source the Torah, is the source of law, then future laws based on this law will withstand the test of time and will remain true and upright.  When the law is based on falsehood, it is illegal in its very essence and then all laws and actions based on this illegal law will not withstand the test of time, and laws and actions derived will be flawed and  show its true colors as being immoral and illegal.

  Children and teens who are innocent and truthful will clearly see through falsehood.

Laws based on falsehood is the root of all the immoral and illegal recent actions perpetrated by the Government of Israel which involve expulsions of Jews from their homes.  They have been violating Biblical Commandments left and right with the latest being the terrible treatment of minors who are subjected to being thrown out of their homes in freezing weather in the middle of the night.  

Even great Rabbis are blinded.   

International Media, Jewish organizations and media, financed from evil sources such as George Soros,  portray such evil expulsions in a positive light, and the settlers in a negative light.  Police obey "orders" from self appointed muckity mucks and then lie,distort and hide the truth.  All in the name of the "rule of law."

Torah Shebeal Peh not based on Torah Shebichtav but sadlly rooted in a lack of Emunah or fear of G-d, but rather fear of the Nations, will not withstand the test of time.  We are all human and the desire for money, power or honor or our lives, sometimes overtakes our better judgement. Hashem Yaazor.  When the Oral Law is not consistent with the Written Law of the Torah it will tragically be proven false chas vechalila. And it will not take a great individual to recognize the flaws. It will be Emuna Peshuta of the child to recognize the flaw. 

We must recognize these error in judgements before it reaches tragedy Chas Veshalom.

Rav Eliashiv is of the position that  "there is a halachic prohibition to enter the tomb in Nablus without first coordinating the visit with security forces as it constitutes mortal danger to both the worshipers and the IDF soldiers." yet this means coordinating visits with the PA security forces whose very essence represents impurity compared with the personal holiness so exemplified by Yosef Hatzadik and revered by the Breslov Chasidim.  Rather than have a moral IDF defending Kever Yosef, like a strong Chareidi unit, Rav Eliashiv seems to prefer an immoral PA Security force for which Jewish worshipers are at their mercy as was demonstrated by the tragic murder of Yosef Livnat HY"D.

The UN is violating international law and Article 80 of its own Charter.

1) COULD ANYTHING BE MORE CLEAR THAN THE JEWISH RIGHTS TO ISRAEL?

The Bible promises our ancestors Abraham Isaac and Jacob that this land is promised to the Jews, thus it is referred to as "The Promised Land".

In Genesis, chapter 48, verse 3-5: Jacob, renamed "Israel" tells his son Joseph: 

"El Shaddai has appeared to me in Luz in the land of Canaan and he blessed me. He said to me: "Behold, I will make you fruitful and numerous. I will make you a congregation of nations. I will give this land to your offspring after you as an eternal possession."

We have a 3500 year title to this land. Not many nations on this earth have a similar claim.

2)The Supreme Council of the Principal Allied Powers which had the power of disposition to divide the Ottoman Empire gave this land after WW1 to the Jewish People worldwide in which to reconstitute their national homeland, recognizing their historical connection to the land.

3) Articles 2,6 and 11 of the Palestine Mandate ensure that the Jewish People have the right to settle in every square inch of the Mandated State of Palestine, (including from the Jordan River to the Mediterranean Sea) and Article 5 prohibits any land from being ceded to foreign powers.

4) The League of Nations approved the Supreme Council's decision. The League of Nations and its membership, are bound by that decision.

5)The United Nations inherited it and approved it. All the UN members, including the Arab memberstates and the UN itself, are bound by this decision.

6) Nothing in law has since repealed any of those rights

7) Article 80 of the UN charter,

confirm that all rights derived from Mandates, are still in full force and effect and do not expire

All the above noted parties - The League of nations, the UN and their membership, are prevented IN law by the Doctrine of Estoppel and the principle of Acquired Legal Rights from taking a position which runs contrary to that which they already agreed to uphold , namely that ISRAEL HAS AN ABSOLUTE RIGHT TO SETTLE IN ALL THE LANDS BETWEEN THE MEDETERANIAN AND THE JORDAN RIVER. Including Judea Samaria and Gaza.

9)The Arab nations - which evicted, robbed, pillaged, murdered their Jewish citizens- never respected their agreements and declared many wars of annihilation against Israel before Israel liberated Judea and Samaria. Thus, they cannot use Israel's presence in Judea and Samaria as a pretext for attacking Israel. Egypt Turkey and Iran have ceased to be at peace with Israel.

Extracting an Arab State out of Israel would render Israel 9 miles wide &indefensible .Extracting concessions under duress is illegal. Israel owns this land lawfully and does not need to give it to anybody, even if they are the nicest people in the world

The terms of the Mandate for Palestine, formulated by the Supreme Council of the Principal Allied Powers as a part of the settlement of the First World War, were subsequently approved and confirmed by the Council of the League of Nations.

11)The right to establish Jewish civilian settlements anywhere in the Land of Israel, including Judea, Samaria and Gaza was incorporated into Israeli constitutional law by virtue of Article 11 of the Law and Administration Ordinance (1948), as well as by the Law of Return, enacted by the Knesset in 1959, which formalizes the pre-existing Jewish Right of Return that applies to all of the Land of Israel, not merely to the State of Israel. A

Dear Rabbanim, Media, Knesset Members and fellow activists

By the time we got the urgent email from Nadia, see below, about the real time destruction of Mitzpe Avichai, it was too late to do anything for Mitzpe Avichai. But it's not too late to prevent something like this from happening again chas vechalila.  

Besides the illegality of such an atrocity,  does the gov't really need to use Arabs for their dirty work.  Don't get me wrong.  It would not be any more Kosher if they employed  US troops to do their dirty work... After all I'm not racist or anything...... 

I would like to know if these Arabs are paid employees of the Israeli gov't?  I am sure many Arabs who hate Jews would be thrilled to do it for no pay but for the honor alone. Is looting part of the deal?.  Boy this job pays realllllllllly well. I'm sure many Jew haters out there will be thrilled to yank Jewish kids and their parents out of bed, traumatize them at 3:00 am and then loot for an added insult to injury.....

Women in Green's reaction to last night's destruction in Mitzpe
Avihai-Kiryat Arba

At 2:30 in the middle of the night, with 0 degrees celcius outside,
some 20 children were dragged away from their beds together with their
parents and were told: "Jews-OUT!" Immediately thereafter the tractors
ran over and destroyed their homes.

The Mitzpe Avichai neighborhood was built on land that belongs to the
municipality of Kiryat Arba Hevron and was already destroyed ten
times. Every destruction brings about construction, especially in
Mitzpe Avihai, and thank G-d, the neighborhood has already eight
families and public buildings.

Once again the IDF used Arab workers to do the dirty work of expelling
Jews from their homes and, by the way, these Arabs stole jewelry and
work utensils from the expelled Jews.

Women in Green call upon all to donate funds in order to rebuild the
neighborhood. We also call upon the Prime Minister to stop hiding
behind Ehud Barak and finally start building the Land of Israel
proudly. This is the one and only answer to Yair Lapid and Sheli
Yachimovitz.

The government of Israel has to stop the game of jumping once to the
right and once to the left. It does not help at all. Only with a clear
policy of applying Israeli sovereignty over Judea and Samaria, the
building of thousands of homes, and the spreading of the population
from the shore to the mountains, will deterrence be built. Only this
way will our country be built.

Now let's talk about the "Legality" of such an operation in Judea and Samaria according to Israeli Law. Listen to Mark Kaplan, Director of the Office of Israeli Constitutional Law (OFICL)on the following youtube explain what the real Israeli Law is and how this operation is clearly illegal according to Israeli Law.
