עתירה לבג"ץ: להפסיק את השימוש בבואש בהפגנות החרדים
הפגנת 'הפלג הירושלמי' מממשיכה לעורר סערה: אחרי שאמש התיזה המשטרה בואש בניסיון לפזר את המפגינים, שורה של עיתונאים וחברי כנסת מגנים את התנהלות המשטרה בטענה כי מדובר באכיפה בררנית | הבוקר הוגשה עתירה לבג"ץ נגד המשטרה
במהלך הפגנת 'הפלג הירושלמי' אתמול (שלישי) בירושלים, נרשמו עימותים קשים בין כוחות המשטרה למאות המפגינים שמחו בעקבות מעצרו של תלמיד הישיבה העריק שנעצר בצפת בתחילת השבוע. בניסיון לפזר המפגינים לפנות את צירי התנועה שנחסמו, השתמשה המשטרה באמצעים לפיזור הפגנות, ובין היתר התיזה באוש באמצעות מכת"זית, דבר שעורר את זעמם של המפגינים.
עיתונאים וחברי כנסת רבים מחו על ההתנהלות המשטרתית ועל השימוש בבואש, וטענו כי מדובר באכיפה בררנית. "אכיפה בררנית היא רשע. מבחינת משטרת ישראל יש אזרחים סוג א', פריבילגים שמאלנים שמפגינים בבלפור וזוכים לכפפות משי, ואזרחים סוג ד', חרדים ומתנחלים, שזוכים לאלימות מטורפת", כתב אמש חבר הכנסת בצלאל סמוטריץ'.
ל'בחדרי חרדים' נודע, כי בעקבות הסערה סביב התנהלות במשטרה, הוגשה הבוקר (רביעי) עתירה לבג"ץ נגד המשטרה בדרישה להורות למשטרה להפסיק את השימוש בבואש בהפגנות החרדים. מגיש העתירה, איש התקשורת והפעיל החברתי יאיר לוי שמסקר את המחאות בירושלים ונכח אמש בהפגנה, התפלא למראה השימוש בבואש מצד המשטרה בהפגנת החרדים, בעוד שלדבריו בהפגנות השמאל המשטרה אינה משתמשת בכלי זה.
"כבר חודשים ארוכים עד ימים אלו מתקיימות הפגנות שבועיות מול מתחם בלפור בירושלים", נכתב בעתירה, "בשבועות הראשונים של ההפגנות, משטרת ירושלים השתמשה במכת"ז המתיז מים נקיים בכדי לפזר את המפגינים בעת שחסמו את הצומת אקטיבית, אך בשום אופן ובאף פעם לא ב'בואש'. לאור הביקורת הציבורית על המשטרה, המשטרה פסקה לחלוטין את השימוש במכת"ז מול מפגיני בלפור, גם לא במים נקיים"
"אך בהפגנות החרדים", מוסיף לוי בעתירתו, "בעיקר אלו המכונים ה'פלג הירושלמי' שוב ושוב המשטרה משתמשת בבואש, הגורמת לתחושת סרחון מוגברת, גם אם לא מסוכנת, נזק לבגדים, מחנק לא נסבל ואף נזק סביבתי כסוג של הענשה קולקטיבית"
עוד נכתב בעתירה, כי "השימוש לאחרונה בכלי זה, היה אתמול אחרי הצהריים בצומת רחוב שרי ישראל בכניסה לעיר ירושלים, שם במשך שעתיים תמימות, המשטרה השתמשה בבואש על ידי שתי מכתזיות כנגד אלפי מפגינים חרדים, לא הוצג תיעוד כי הדברים פורסמו בכל כלי התקשורת"
בבקשה להוציא צו ביניים שיאסור את השימוש בבואש מסביר לוי, כי אין בכוונתו "לבחון את חוקיות השימוש בכלי זה כאמצעי לפיזור הפגנות, אלא העתירה מבקשת להתמקד אך ורק במה שנראה כאכיפה בררנית, וכהרגשה אף עובדתית שלא כולם שווים בפני החוק, וכלי הבואש שהמשטרה נמנעת מלהפעיל מול מפגיני בלפור, מופעל פעם אחר פעם דווקא מול הפגנות חרדים"
"העיתונאי יאיר שרקי מחדשות 12 כתב ואף הודיע בשידור באותו ערוץ, (שודר אמש) שפנה בשאלה לדוברת המשטרה, מדוע בבלפור הם נמנעים מלהשתמש בכלי הבואש, כל עוד הם משתמשים בו רק כנגד החרדים, הכתב שרקי הוסיף כי בדוברות לא הצליחו להסביר או לתת כל הסבר".
"מהטעמים שהובאו לעיל, כבוד בית המשפט מתבקש להוציא צו ביניים כבר בשעות אלו, שהרי אם השימוש בכלי אינו חוקי (מהטעם של אכיפה בררנית) השימוש יכול לחזור על עצמו בכל רגע, גם בשעות אלו, כי אין לדעת מתי תתרחש ההפגנה הבאה של החרדים".

במהלך ההפגנה הפעילה המשטרה 3 מכתזיות, המכתזיות התיזו חומר מסריח לכל עבר, גם לעבר העומדים על המדרכות וגם לעבר מתחם ההפגנה המאושרת, מהמכתזית נפגעו נשים, ילדים ועוברי אורח.
המפגינים דיווחו על אלימות שוטרים קשה, ובתיעוד שהופץ ניתן לראות שוטר מאגרף במכות אגרוף את אחד המפגינים, כאשר לאחר שניות ארוכות חבריו השוטרים משתלטים על השוטר האלים ולוקחים אותו מהמקום.

להפגנה הגיע אביה של אורי אנסבכר הי"ד שנרצחה ביער ירושלים שהצטרך לקריאה. כעת ליד ההפגנה החלו מפגינים לחסום את הציר. אלימות שוטרים קשה במקום.
המכתזית החלה לפעול במקום והתיזה גם לעבר מאות המפגינים המפגינים במתחם המאושר.
