*שבוע לאחר שנעצר במעצר הזוי ולאחר שעבר תרגילי חקירה בזויים בחסות צו דרקוני שמנע ממנו להפגש עם עורך דינו - בית המשפט הורה על שחרור של תושב בית אל שנחשד ברצח פעיל החמאס לפני שלושה שבועות!*

את המתיישב ייצגו במהלך הדיון עורכי הדין אריאל עטרי ואסף גונן מטעם ארגון חוננו. עו"ד עטרי הגיבה להחלטה ואמר: "בית משפט השלום הורה על שחרורו של החשוד ברצח ובכך ביטא את מה שאנו טוענים מהרגע הראשון: המתיישב החשוד ברצח מחבל החמאס - חף מפשע. אנו מצפים שהשב"כ יעשה חשבון נפש ויפנה את מרצו לחקירת מחבלי חמאס ולא לחקירת חפים מפשע".
עו"ד גונן הוסיף כי "כמו שטענו מהרגע הראשון אין ולו היה שום בסיס ראייתי לחשדות ובוודאי שלא למעצר. מודים לבית המשפט על קבלת טענותינו והפעלת הביקורת השיפוטית"
נזכיר כי מוקדם יותר השבוע, ביקש השב"כ להאריך את מעצרו של המתיישב בחמישה עשר יום, אולם בית משפט השלום בירושלים דחה את בקשתו והאריך את מעצר המתיישב בשלושה ימים בלבד. במהלך הדיון התברר כי עדיין אין בידי השב"כ את תעודת הפטירה של אותו פלסטיני פעיל חמאס, ואין בדיקות המעידות על נסיבות מותו – למרות שהיעדרן התגלה כבר בדיון הקודם.

The Jerusalem Magistrate's Court ordered the police to release to house arrest the Beit El settler who was arrested last week on suspicion of killing a Hamas operative. The release comes after the police asked to extend the settler's detention for additional days. This is in addition to an unusual order issued by the Shin Bet forbidding the settler to meet with his lawyers.
The settler was represented during the hearing by attorneys Ariel Atari and Asaf Gonen on behalf of the Honenu organization. Attorney Atari responded to the decision and said: "The Magistrate's Court ordered the release of the murder suspect and thus expressed what we have been claiming from the first moment: the settler suspected of murdering the Hamas terrorist is innocent. We expect the Shin Bet to take stock and turn its energies to investigating Hamas terrorists and not to investigating innocents."
Attorney Gonen added that "as we claimed from the first moment, there is no evidentiary basis for the suspicions and certainly not for the arrest. We thank the court for accepting our claims and exercising the judicial review"
Recall that earlier this week, the Shin Bet requested to extend the settler's arrest by fifteen days, but the Jerusalem Magistrate's Court rejected his request and extended the settler's arrest by only three days. At the funeral of the Hamas activist, many inflammatory words were heard and among other things, the participants chanted "We are the people of Muhammad Daf".
