בלילה שבין חמישי לשישי, 31 ביולי 2015, לא דקה אחת לפני חצות, זמן כניסת אותו תאריך, השליך אחד מכעשרים יהודים צעירים המכונים 'נוער גבעות', שני בקבוקי בירה ירוקים, אותם מילא בדלק, בעומדו ליד בית משפחת דוואבשה, לפני שהשליך אותם מבעד לשני חלונות שניפץ. כתוצאה מכך, תינוק והוריו נספו בדליקה. דבר זה היה ברור לגמרי, עוד לפני חקירה.

מידע זה נמסר לחוקרי כוחות הביטחון מיד אחרי האירוע, מפי כמה מתושבי הכפר. בידי השב"כ , שמצהיר היום, 7.1.16, חמישה חודשים לאחר מכן− "הכל בידינו", עדויותיהם החשובות של התושבים שהיו במקום בעת ההצתה, והמספרים לחוקרים, עוד באותה שחרית, הן על כך שהיה רק מצית אחד, והן על שניים, שלושה וארבעה, מה שהוסיף בהכרח אמינות לכל אחד מהמעידים.

אור ליום שישי 31.7.15, התייחס דובר צה"ל תא"ל מוטי אלמוז  לדליקה בכפר, וציין כי מדובר באירוע חמור מאד. הוא.סיפר באותו בוקר, כי האירוע החל קצת לפני ארבע בבוקר כששני רעולי פנים חדרו לבית בכפר דומא סמוך לישוב מגדלים.רעולי הפנים פנו תחילה לבית ריק ובהמשך, לבית משפחת דוובשא שברו את החלונות וזרקו בקבוקי תבערה לתוך הבתים. שני הבתים הם מאוכלסים, אחד מהם במקרה היה ריק". ועוד נכתב על קיר הבית- "נַקמַה" , שפורש כנְקמָה.

אי לכך, "את החקירה תוביל היחידה לפשיעה לאומנית" יהודית. אותה שעה ממש, אמר השר לביטחון פנים (שר המשטרה)−"עדיין אין קצה חוט לתפיסת מבצעי הרצח בכפר דומא ".

היחידה לפשיעה לאומנית מצאה כי  בחלוקת העבודה בין השניים שנראו לכפריים בדומא− מחתרת שמטרתה להפוך את המשטר ולהמליך מלך− שלח המצית בפועל, עמירם בן-אוליאל, את אלישע אודס,  קטין יהודי בן 16 , למשימת איתור מקום נגיש להצתה, ממנו נוח להימלט. בית דוואבשה, הממוקם במרכז הכפר דומא, נבחר בהיותו מקום העונה על צורך זה.

היו מי שטענו שההצתה נבעה מסכסוך פנימי בכפר, ולא נגרמה בידי יהודים, ואכן, כחודש לאחר מכן, הוצת בית נוסף של משפחת דוואבשה. הפעם, כוחות הביטחון קבעו סופית, כי "השריפה שהתלקחה לפני 3 ימים לא התרחשה על רקע לאומני. לפי בדיקות שנערכו, השריפה ככל הנראה התרחשה עקב קצר חשמלי או עקב הצתה". "ככל הנראה", כי תמיד קשה לקבוע אם היה קצר או לא. מכל מקום, שלא כמו ההצתה לפני חודש, שאז היה פשוט למדי לקבוע שלא היה קצר חשמלי, גם לא סכסוך חמולות, ומכאן שרק יהודים, מה עוד שכתבו בעברית – נַקמַה. לכן, למחרת לא התייחס דובר צה"ל תא"ל מוטי אלמוז  לאותה דליקה, ולא ראה צורך לציין כי מדובר באירוע חמור מאד. ערבים נגד ערבים, אינו בתחום חקירת השב"כ או צה"ל.

באותו בוקר, בשעה  08:59 עמד  שר הביטחון יעלון,  בראש שורת מגנים מכל שדירות נושאי משרות המדינה. ח"כ ענת ברקו מילאה  את סאת הצער וההאשמות, ב- 14:06 . רה"מ נתניהו שוחח עם יו"ר הרשות הפלשתינית אבו מאזן והביע זעזוע מהמעשה. נתניהו אמר למקבילו ברשות, כי "עלינו להילחם יחד בטרור ולא משנה מאיזה צד הוא".

הרוצח, עדיין יהודי אנונימי מופשט − אחד מבין 20 שנעצרו ושוחררו− היה כאמור, חבר מחתרת מסוכנת שרצתה "להפוך את המשטר, ולהמליך מלך"; מחתרת הידועה לשב"כ ברעיונותיה. שמות חבריה ידועים פחות, אך עד מקרה דומא היו גם מעשים− הצתות של מסגדים וכנסיות, חלקן בידי ערבים, אך המציתים לא הוכרו כחברי מחתרת מאורגנת שהכריזה על עצמה בשם כלשהו.

עמוס הראל וחיים לוינסון כתבי  'הארץ' מצטטים "הערכה במערכת הביטחון: מטרת המציתים בדומא - הפיכה מבוססת הלכה. במערכת הביטחון מעריכים כי קבוצה של עשרות פעילי ימין קיצוני עומדת מאחורי הצתת מסגדים, כנסיות ובתים פלסטיניים. הם לא מסתפקים בהרתעה מפינויים וחותרים לערער את יציבות השלטון".

מנגד, בכתב האישום נגדם נאמר רק, כי לאחר רצח מלאכי רוזנפלד ז"ל בידי פלסטינים ביוני 2015, קשרו עמירם בן-אוליאל והקטין הנאשם עימו קשר לבצע פיגוע נקמה נגד ערבים.

ארבעה חודשים אחרי אירוע דומא− הם הוגדרו כפצצה מתקתקת.  מחתרת השניים נעצרה רק כעבור 4 חודשי חופש בהם עקב אחריה השב"כ. 4 חודשים שבסופם, אחרי הרשעתם המיידית ע"י הרמטכ"ל, שר הביטחון, ראש הממשלה, נשיא המדינה, ח"כים ואחרים, "ישראל עדיין מנסה לאסוף ראיות נגד אנשי הימין הקיצוני שנעצרו בחשד להצתה בכפר דומא ביולי האחרון: עושים הכל כדי שיהיו ראיות", לדברי השר לביטחון פנים. בשלב זה כבר יכלו להצטרף למרשיעים, רבנים, ראשי מועצת יש"ע ודומיהם. הרב אלי סדן אף אמר ש"צריך לנשק לשב"כ את הידיים והרגליים". ברשימת המגנים היו בין היתר הרבנים: גיסר אברהם, גלעד יהודה, הרשקוביץ צחי, לאו בני, נבון חיים, נויבירט רונן, סתיו דוד, פוירשטיין רפי, קורן צבי, רונצקי אביחי, שלמה ריסקין,שרלו יובל.

הפצצות המתקתקות − הקטין אלישע אודס ועמירם בן-אוליאל, נעצרו רק אחרי שהן חשו במעקב אחריהן (השב"כ לא עצר אותן לפני כן, כי "רצה להמשיך לעקוב"), ולכן עברו להתגורר בירושלים, שם לא תשיגם יד השב"כ: "המעבר של בן-אוליאל עם אשתו ובתו  לירושלים שיכנע את החוקרים שבן-אוליאל הוא הרוצח. אז חשש השב"כ שהקטין ינסה עוד התקפה בירושלים". לכן אז הם הוגדרו כפצצות מתקתקות. אחרי 4 חודשים שהתגלגלו חופשיות. רק אז, למרות שכבר מן ההתחלה "היה בידינו הכל", נזקק השב"כ להשתמש ב"אמצעים מיוחדים" – עינויים כפי שהודה− השמורים לניטרול פצצות כאלה. העינויים הוכחשו כל אותה עת,עד שאושרו כנכונים ע"י השב"כ, זמן רב אחרי שעיתונאי בעתון המגזר 'מידה', חגי הוברמן, כתב כי "ברור שחלק גדול מהתיאורים על ה'עינויים' והסדיזם רחוקים מלהיות מדוייקים.אחרי שיחות ארוכות שניהלתי עם גורמים רבים, יש לי יסוד סביר להאמין לדברים שאמרה שרת המשפטים איילת שקד לאחר שבחנה את הנושא לעומק עם היועץ המשפטי לממשלה ועם ראשי השב"כ: לא היו עינויים פיזיים. כל ההליך מתבצע בליווי צמוד של מערכת המשפט ובהתאם לחוק. כל חקירות השב"כ מצולמות, מתועדות, ועוברים אישור של ראש השב"כ עצמו. העצורים כבר ראו עורך דין, ומצבם הרפואי תקין. הם נבדקים בצורה סדירה על-ידי רופא. ובניגוד לטענות ולפרסומים, לא התבצע ניסיון התאבדות על-ידי אחד מהעצורים, אלא אם מישהו ייתן תשובה הגיונית איך עציר שנמצא תחת מעקב של 24 שעות ביממה השיג סכין לחתוך את ורידי עצמו". ובאמת, איך יכול היה  הוברמן לשער שהשב"כ עצמו יבטל את דבריו?

ובינתיים התבררה דרך קבלת האישורים לעינויי הנערים. האישור לענות את העצורים  התקבל מהזנב לראש: תחילה פנה השב"כ, הזרוע המבצעת, ליועהמ"ש דאז, ויינשטיין, מבלי ליידע את רה"מ אליו הוא כפוף ישירות. אותו ויינשטיין אישר "אמצעים מיוחדים" לשב"כ, שתרגם אותם מיד לעינויים, ומיד החל בהם, עינויים שנמשכו עד לקבלת ההודאות. רק אז פנה ראש השב"כ למעסיקו הישיר, לראש הממשלה ודיווח לו בדיעבד. כל המהלך הזה התנסח בפי שרת המשפטים איילת שקד, כך: "ביררתי עם היועץ המשפטי לממשלה ועם ראש השב"כ וראיתי שהכל נעשה לפי חוק."

כאן נשאלת בהכרח השאלה: אם מן ההתחלה השתבח דובר השב"כ בכך  ש"הכל בידינו", וחייבות על-כן להיות אלה, בראש ובראשונה, ראיות פורנזיות, אזיי אין צורך בהודאה, מה עוד, שההודאה לא קבילה לפי חוק, משום שנגבתה תחת עינויים, ושגם אילולא זאת, היא מחייבת  "דבר מה נוסף", שאינו שחזור שכמוהו כהודאה. אומר משה אודס, אביו של אלישע העציר הקטין: "במהלך המשפט עצמו מודה הפרקליטות כי אין לה שום ראיות למעט ההודאה מצד הבן העצור".

פתרון לבעיה זאת נמצא לשב"כ, תחילה במשפט זוטא בו תבעה הפרקליטות שיתקבלו ההודאות משום שגם בעינויים "נשמר כבוד הנחקרים" והם "הודו מרצונם החופשי". כעבור ימים ספורים חזרה בה,ועכשיו טענתה היא, שאמנם היו עינויים, אבל החתימה על ההודאות נעשתה שלא בעת העינויים.

בסוף ספטמבר יינתן בעז"ה פסק דין במשפט הזוטא. עד אז ומתחילת 15 הארכות המעצר לפני כשנתיים וחצי, כל אחד מהעצירים נמצא בבידוד מסיבות בטחוניות, יוצא לחצר רק שעה ביום, נפגש עם עו"ד בנוכחות סוהר (שב"כ?) ואינו מורשה להתפלל במניין.

אחד? שניים?

זה המקום להביא את עדות תושבי דומא בליל ההצתה: "שני מתנחלים רעולי פנים"!

במסמכים המצויים בידי החוקרים, נמסרו עדויות משני תושבי הכפר דומא, הגרים בסמוך לבית משפחת דוואבשה שהוצת, שהגיעו באותו לילה למקום וראו בבירור שני אנשים רעולי פנים נמלטים מהזירה.  (כתבה מ-3.3.16)

גירסא מתבקשת: שני תושבי הכפר נוהגים להגיע לבית דוואבשה מידֵי לילה לפני ארבע בבוקר. (דובר צה"ל תא"ל מוטי אלמוז : "האירוע החל קצת לפני ארבע בבוקר כששני רעולי פנים חדרו לבית בכפר דומא)

גירסא אחרת: נדדה שנתם של שני תושבי הכפר, במקרה באותו לילה, וטיילו בקירבת ביתם שליד בית דוואבשה.

מכל מקום, אין לפקפק במהימנות עדויותיהם, למרות כמה שאלות:

1. האם התבקשה תשובה להנָחות שלעיל.
2. האם התקבלה גירסת העדים על מספר המציתים.
3. אם התקבלה גירסת העדים, מדוע כתב האישום על רצח הוא נגד אחד בלבד.
4. האם התקבלה בכללה גירסת העדים, למַעט מספר המציתים.
5. אם לא התקבלה גירסת העדים, ולדעת השב"כ היה רק מצית אחד,שגם שיחזר פרטים מוכמנים כגון צבע הבקבוקים וסוגם, מכונית סקודה שחנתה ליד הבית, ריצתו, נפילתו והמשך ריצתו, עליה לא דיווחו העדים הכפריים, האם העדויות עדיין אמינות.

השב"כ מצא התאמה נוספת בין עדות החשוד ועדויות הכפריים: "מבלי לדעת מה סיפרו הכפריים, סיפר בן-אוליאל לשב"כ (בתשובה לשאלת החוקרים האם רץ בלי לעצור או ליפול) שרץ,נפל, קם וברח". עדותו תאמה את עדות הכפריים  (ש[אחד]"עמד", שהם "נמלטו", ש"הם ברחו")

אחד מ(שני) העדים תיאר עוד: "ראיתי שני אנשים לבושים בלבוש אחיד וכיסוי שחור, שמכסה את כל הראש, כולל הצוואר, עם פתח לעיניים, לפה ולאף, וחולצה ארוכה, שרוולים ארוכים שחורה ומכנס ג'ינס שחור. אחד מהם עמד קרוב לראש של ריהאם והשני קרוב לראש של סעד". אחד העדים אמר: "צעקתי בקול רם כדי להעיר את השכנים, וכשחזרתי למקום ראיתי שהם ברחו" (העדויות מתומללות ומתורגמות מערבית ).            

איננו יודעים מה בכתב האישום, אך ידוע שהוגש רק נגד מצית יחיד, בן-אוליאל. חבר המחתרת השני, אלישע אודס, לא הגיע לדומא. הוא נשאר במערה בה החליטו להיפגש, ולא נפגשו, על פי עדותו. אבל, "העדות על שני חשודים ולא אחד מאוששת על ידי מסמך אחר, הטוען כי גשש של צה"ל  [בדואים בדרך כלל] זיהה עקבות של שני חשודים ולא אחד, מהציר לדומא ובחזרה. עכשיו זה מסתדר עם עדות תושבי הכפר, פחות עם הגשת כתב אישום נגד אחד בלבד.

עד כאן כל הידוע לנו על פרשת דומא.

בינתיים מחכים העצירים המבודדים בתאם, מכוח צו המעצר ה-15. מחכים בימים ובלילות ללא שינה בני משפחותיהם, ומחכים גם אנחנו המבולבלים מעט, להחלטה במשפט זוטא− ההודאות תחת עינויים קבילות או לא. היו תחת עינויים, או לא. יהיה משפט גם אם אינן קבילות, או אין מלבדן לפרקליטות בדל ראיה למעט ההודאה, שאם כן, העצירים ישוחררו בלא אשמה, והמאשימים יוליכו את קלונם הרחק מעין הציבור.

So, the New York Times has published a list of 49 questions purported to be the ones special counsel Robert Mueller wants to ask President Trump. Here is a completely hypothetical response to Mueller that I would dearly love to see from Trump. Here, New York Times:

Dear Mr. Mueller:

I have just seen the long list of questions in the New York Times that are alleged to be from you. Since the Times has occasionally been known to print leaked material that turns out to be incorrect, I don't know if these really are the questions you intend for me or not. But in case they are, I have to say that they are ridiculously open-ended (Witch Hunt!!) and would take many hours to answer fully, and I kind of have a lot on my plate right now, what with working to end the Korean War, secure the border against an incoming hoard and figure out what to do about those lyin' Iranians who clearly are on the path to nuclear bombs. I hear you don't care about this and may want to subpoena me. Before you take that step, though, I have a request: answer this list of just 10 similarly open-ended questions I have for YOU.

"Colored boy"

If I told you that a conservative media outlet had referred to a prominent African-American celebrity as a "colored boy" because they didn't like his politics, how long do you think it would be before Twitter mobs descended in justifiable outrage over such a condescending racist insult?

Well, that's the exact term that smugly liberal NPR (National Public Radio) used in its headline on an article attacking hip-hop star Kanye West for offering support to black conservative Candace Owens and refusing to condemn President Trump, instead defending his right to think independently.

A reminder: your taxpayer dollars are paying for this. Don't ask me why.

Who leaked to the NY Times?!?

In yet another leak masquerading as journalism, the New York Times printed a lengthy list of what it claims are questions that special counsel Robert Mueller wants to ask President Trump. You can read more about them at the link. Suffice to say, it's an entire tackle box full of lures for a fishing expedition, very few of which have any relation to the alleged object of the probe, "Russian collusion" to influence the election.

They range from questions about Trump's business dealings with Russia to whether he knew about Jared Kushner's efforts to set up back-channel communications with Russia prior to his Inauguration (which as President-elect, he had a perfect right to do, and it was after the election) to his motivations for firing FBI Director James Comey (Ooh, let me answer that one! He was motivated to fire Comey because everyone on both sides agreed that he richly deserved to be fired – up until he was, of course -- something he continues to prove every time he opens his mouth; and Trump probably realized that as President, he had both the duty and the unquestionable power to fire him at any time for any reason. Next question!)

What the media gets wrong about the WHCD?

Good article: Tony Williams at the Victory Girls Blog explains to White House Correspondents' Association president Margaret Talev that not only did they fail in their purported efforts to "build a spirit of unity," but they also failed to grasp the basic flaw in their self-aggrandizing mission statement. As Ms. Talev put it at the dinner (or as I've seen several pundits describe it since, the "dumpster fire"):

"We reject efforts by anyone, especially our elected leaders, to paint journalism as un-American, to undermine trust between reporter and reader, or to cast doubt on the relevance of fact and truth in the modern age."

Kudos to Ms Williams for pointing out bluntly that journalism is not under attack, "fake news and liberal bias is under attack" – and contrary to what many in the media seem to believe, those aren't the same thing. Nobody believes journalism is un-American or wants to cast doubt on facts and truth. We just don't trust journalists who have squandered our trust by rushing to air phony, poorly vetted or deliberately slanted stories that promote their own political views, or who make it clear through events like that dinner that they have nothing but hatred and contempt for millions of Americans whom they expect to look up to them as beacons of unvarnished truth.

A week of news - my weekend monologue

Just a few hours after we taped last week's show and a few miles from our studio, a man entered a Waffle House in Nashville and randomly shot and murdered 4 people and wounded several others. I won't give the name of the deranged young man who did the killing because it's my policy to never help mass murderers become famous or see their names or faces in the papers or on TV. But there is someone I hope becomes famous from that tragic situation—James Shaw Jr, a young father who grabbed the gun and threw it over the counter causing the killer to flee. The gunman evaded capture for more than a day before being arrested and charged with the murders. He has a long history of mental illness and firearms had been taken from him, but his father appeared to have given them back.

Enough about the killer. Let's focus on James Shaw Jr., an honest to God hero. He acted instinctively and instantly. He first risked his own life for had the gunman been able to reload, the next victim would have been James Shaw. Secondly, he saved the lives of other people at that Waffle House. They owe their very existence to the actions of someone who exemplified what Jesus said was the greatest form of love: "There is no greater love than to lay down one's life for his friends."

LAG BAOMER - RABBI SHIMON BAR YOCHAI: THE SCHOLAR-WARRIOR

As Lag Ba'Omer rolls around, one is reminded of the holy Rabbi Shimon Bar Yochai (Rashbi רשב"י). The multitudes of Jews from all sects of Israeli life who flock to his grave site in Meron מירון is testimony to the deep admiration that the Jewish People have for this very special Jewish figure.

Rashbi was the prized student of Rabbi Akiva who was one of the Ten Martyrs of the Jewish Kingdom. Not for nothing did the Romans give Rabbi Akiva the death penalty, for he played a central role in the organization of Bar Kochba's rebellion. The Rambam, at the end of Hilchot Milachim even says that Rabbi Akiva was Bar Kochba's "arms-bearer."

The 24,000 students who went in Rabbi Akiva's footsteps and fell in the war against the Romans, died during the "Sefirat HaOmer" period, and the traditional restrictions we practice today are an expression of the struggle of the Jewish nation for spiritual independence. Rabbi Akiva himself sat in prison for several years for denying the Roman decrees by holding public Torah rallies. For this he was eventually tortured and executed.

These were the two sides of the leadership of Rabbi Akiva: The willingness to go out and sacrifice for national sovereignty as well as the ultimate self-sacrifice for Torah. The fierce combination of nationalism and Torah that burned in his bones was passed onto his students, and the greatest of them all was the scholar-warrior Rabbi Shimon Bar Yochai who was ordained by his Rav after the rest of the students were killed in the revolution. Rashbi established the basic Torah foundations of the Oral Law as we know them today. His Yeshiva put out the likes of Rabbi Yehuda HaNassi who arranged the Mishnah. But just like his "Rav", Rabbi Akiva, Rashbi went beyond the learning and teaching of Torah. He never stopped trying to bring back Jewish sovereignty to Eretz Yisrael, and abhorred with all his soul the Roman occupation.

His belligerent attitude towards the Romans he made no secret of, even when it meant putting himself in danger for just expressing such opinions. We are told in Trachtate Shabbat, 33: "Once Rabbi Yehuda said, 'How fine are the works of this nation (Rome). They have made streets, they have built bridges, they have erected baths.' Rabbi Yossi remained silent (from fear). Rabbi Shimon Bar Yochai answered and said, 'All that they have made they have made for themselves; they built market places to put harlots in them; baths to rejuvenate themselves; bridges to levy toils for themselves'." When these words got to the Roman authorities, a price was put on his head and he was forced to go underground for 13 years. During this time, he and his son Elazar were miraculously kept alive, and to them were revealed the wonders of the hidden Torah (which was collected in the "Zohar"). These difficult times did not break him, but only reinforced his hatred for this evil empire and he continued his struggle against the Romans to liberate the Jewish People.

Though Lag Ba'Omer falls during the "sefirah" where we mourn the death of Rabbi Akiva's students, it is a day of rejoicing. For when all the other students of Rabbi Akiva were killed in war, Rashbi managed to survive. He symbolizes the vitality of those who fought the Romans. He represents the continuation of the scholar-warrior. He is the eternal flame that cannot be extinguished, and will remain en-kindled until the final victory of complete redemption, may it come speedily in our days. AMEN!

My gut feeling was that your analysis on PM Netanyahu was not coming from a good place. 

  For now I am not disputing  the facts.  But are you sure that this is coming from a place to protect Israel's best interests or rather as a personal vendetta to the competition who is now getting amazing Press..

Maybe Netanyahu under his leadership  made serious mistake in not attacking Iran years ago.  

Bolton was pushing for it.

However, once the mistake happened he shouldn't be blamed for Obama's antisemitic pro nuclear Iran deal empowering  nuclear terror that he could not do anything about.

How to move on rather than just blame.

You Moshe Feiglin wrote a scathing article about President Trump for absolutely no good reason during the American Presidential campaign.  Why was that  at all helpful?  Now you call  him a good person?.  DId you ever admit that you made poor judgement about Trump? 

The point is that we all make mistakes.  

What were you thinking at the time? Ok you made a mistake. Had you been Prime Minister of Israel, that foolish outburst against Trump would not have worked to your benefit.

There is good chemistry between Netanyahu and Trump. 

How do you know  that Israel and America are not working hand in hand now to eliminate the Iranian  threat.  Why do you just assume that Israel is passing the buck.

It is in Americas and Israel's best interest to denuclearize Iran.  Netanyahu is helping America do what it needs to do on the political front to politically end the Iran Deal; and start implementing sanctions etc.  

Israel nor America can fight Iran alone.  We all need to work together.  

I am at this point hopeful that US and Israel are collaborating  and it was a planned decision by both countries to have Netanyahu  expose Iran's Nuclear ambitions with an impressive presentation. 

Now Trump will take it  into his ballpark and end the Iran Deal.  Both Trump and Netanyahu will  look good.  Who will actually attack militarily Iran's nuclear facility?   Hopefully the military intelligence of the two countries will combine their efforts and resources and get the job done.. 

DO you know for a fact that they are working independent of each other and Israel is merely passing the buck in US's court?

Bashing Netanyahu is counter productive at this point in time is my personal take on this.
